The inspection of the granted use of water resources in a basin declared in a critical situation of water scarcity. Case study: case study in the Suaçui River watershed - MG

Resumo: In the framework of the Minas Gerais State Water Resources Policy, was published in 2015, Normative Deliberation No. 49 of March 25, 2015, amended by CERH-MG Normative Deliberation No. 50 of October 9, 2015, which establishes guidelines and general criteria for the definition of Critical Situation of Water Shortage and Restricted State of Use of Surface Water Resources in the hydrographic portions of the State of Minas Gerais. The present work aimed to analyze the effectiveness of such legislation, as a way to ensure the prevention or mitigation of damage from the occurrence of adverse hydrological events such as: preventing or minimizing the effects of drought; prevent or alleviate severe environmental degradation; meeting priority uses; and minimize impacts on multiple uses. From data obtained from the environmental agencies managing water resources, an analysis was performed on the act that declared Critical Situation of Water Shortage and State of Restricted Use in the hydrographic portion upstream of Vila Matias Station, Suaçui River basin, and the actions taken by environmental agencies in order to comply with current legislation. The analysis showed that during the enforcement action on the granted users, it was not possible in any of the uses to measure the flow captured, and consequently to verify if the imposed restrictions of use were taken. However, due to non-compliance with the obligation to install flowmeter and hourmeter equipment, 75% of the supervised uses were assessed and suspended, which contributed to mitigate the effects of drought in the basin.

El presente trabajo tuvo como objetivo analizar la efectividad de dicha legislación, como una forma de garantizar la prevención o mitigación de daños resultantes de la ocurrencia de eventos hidrológicos adversos tales como: prevenir o minimizar los efectos de las sequías; prevenir o mitigar la degradación ambiental grave; cumplimiento de usos prioritarios; y minimizar los impactos en múltiples usos. Con base en los datos obtenidos de las agencias ambientales que administran los recursos hídricos, se realizó un análisis sobre el acto que declaró la Situación crítica de escasez de agua y el Estado de restricción de uso en la porción hidrográfica aguas arriba de la estación de Vila Matias, en la cuenca del río Suaçui, y las acciones tomadas por las agencias ambientales para cumplir con la legislación vigente. El análisis mostró que durante la acción de inspección en los usuarios otorgados, en ninguno de los usos era posible medir el flujo capturado y, en consecuencia, verificar si se tomaron las medidas de restricción de uso impuestas. O presente trabalho teve como objetivo analisar a eficácia de tal legislação, como forma de garantir a prevenção ou mitigação dos danos provenientes da ocorrência de eventos hidrológicos adversos como: prevenir ou minimizar os efeitos de secas; prevenir ou minorar grave degradação ambiental; atendimento aos usos prioritários; e, minimizar os impactos sobre os múltiplos usos. A partir de dados obtidos junto aos órgãos ambientais gestores de recursos hídricos, uma análise foi realizada sobre o ato que declarou Situação Crítica de Escassez Hídrica e Estado de Restrição de Uso na porção hidrográfica à montante da Estação Vila Matias, bacia do Rio Suaçui, e as ações tomadas pelos órgãos ambientais de forma a cumprir a legislação em vigor. A análise mostrou que durante ação fiscalizatória sobre os usuários outorgados, não foi possível em nenhum dos usos mensurar a vazão captada, e consequentemente constatar se foram tomadas as medidas de restrição de uso impostas.
