The conditions of the Brazilian prison system in contrast to the fundamental rights of incarcerated women

Resumo: In the current legal context, the discussion about aspects concerning the conditions of the Brazilian penitentiary system persists in contrast to the fundamental rights of incarcerated women, both in general and in their specific properties. In this sense, the objective of this article was to examine the concept and origin of the prison system, the penalty and the rights of the incarcerated individual, and how they are realized in the Brazilian social environment, aiming, with this, to understand the legal aspects related to the rights of the prisoner. imprisoned women and, finally, the specific factors about women in the prison system. In this perspective, the present article, by means of exploratory research, of qualitative nature, deductive method, collection of documental and bibliographic data, was developed in order to carry out a historical investigation on the theme, reaching the result that, although there are many advances regarding the fundamental guarantees provided to female citizens in Brazil, challenges, not only within the scope of Criminal Law, to be overcome for these people to fully exercise their human dignity.

En este sentido, el objetivo de este artículo fue examinar el concepto y el origen del sistema penitenciario, la pena y los derechos del individuo encarcelado, y cómo se realizan en el entorno social brasileño, con el objetivo de comprender los aspectos legales relacionados con los derechos del preso. mujeres encarceladas y, finalmente, los factores específicos sobre las mujeres en el sistema penitenciario. En esta perspectiva, el presente artículo, a través de la investigación exploratoria, de naturaleza cualitativa, método deductivo, recopilación de datos documentales y bibliográficos, se desarrolló para llevar a cabo una investigación histórica sobre el tema, llegando al resultado que, aunque Hay muchos avances con respecto a las garantías fundamentales proporcionadas a las ciudadanas en Brasil, desafíos, no solo dentro del alcance del derecho penal, que deben superarse para que estas personas ejerzan plenamente su dignidad humana.Persiste, no âmbito jurídico hodierno, a discussão acerca dos aspectos concernentes às condições do sistema penitenciário brasileiro em contraste aos direitos fundamentais da mulher encarcerada, tanto em sua generalidade, quanto em suas propriedades específicas. Nesse sentido, o objetivo deste artigo foi examinar a conceituação e origem do sistema prisional, da pena e dos direitos do indivíduo encarcerado, e de que maneira são concretizados no meio social brasileiro, visando, com isso, compreender os aspectos jurídicos relacionados aos direitos da mulher presa e, por fim, os fatores específicos acerca da mulher no sistema penitenciário.
