Resumo: | Informed consent is a document that intends to inform the patient who is going to undergo a surgical procedure about the risks and benefits of that treatment. It is not only an ethical, but also a legal duty of health professionals working in Surgery services. The informed consent term is based on the principle of patient autonomy, that is, the patient has free will to make decisions about their body and treatment. To identify ethical and legal aspects related to the Informed Consent Form and its importance to guarantee Safe Surgery. In this study, a bibliographic review was carried out analyzing articles from scientific journals and in the SCiELO and academic Google databases about the informed consent form to users who will be submitted to procedures in the Surgical Center and its relevance to guarantee the application of the checklist of Safe Surgery. In the study, it was evidenced that it is of great importance that the information, procedures and treatments to which this patient will be submitted is recorded in a clear, comprehensive way and in terms that can be understood by him or his legal representative, the Consent Term Informed correctly written, it brings security to the patient and especially to the medical professional, who may in the future use it in their legal defense or representation in the class council, in case there is an alleged medical error. The demonstration of good faith, compliance with the duty to inform and respect for the patient's autonomy is essential for the Safe Surgery Check List to be applied correctly because, in view of the clarification of the benefits and risks that it will face, it is appropriate the patient decides whether or not to accept the procedure, as well as makes him aware of the procedure to be performed and will make him an active member in the procedure for checking surgery free of avoidable errors. |

No es solo un deber ético, sino también legal de los profesionales sanitarios que trabajan en los servicios de Cirugía. El término del consentimiento informado se basa en el principio de autonomía del paciente, es decir, el paciente tiene libre albedrío para tomar decisiones sobre su cuerpo y tratamiento. Identificar los aspectos éticos y legales relacionados con el Formulario de Consentimiento Informado y su importancia para garantizar una Cirugía Segura. En este estudio se realizó una revisión de la literatura analizando artículos de revistas científicas y en las bases de datos SCiELO y académicas de Google sobre el formulario de consentimiento informado para los usuarios que serán sometidos a procedimientos en el Centro Quirúrgico y su relevancia para garantizar la aplicación del checklist de Cirugía Segura. . En el estudio se evidenció que es de gran importancia que la información, procedimientos y tratamientos a los que será sometido este paciente se registre de manera clara, integral y en términos que puedan ser entendidos por él o su representante legal, el Formulario de Consentimiento Informado correctamente redactado, aporta seguridad al paciente y en especial al profesional médico, quien en el futuro podrá utilizarlo en su defensa legal o representación en el consejo de clase, en caso de que exista un presunto error médico. La demostración de buena fe, el cumplimiento del deber de informar y el respeto a la autonomía del paciente es fundamental para que la Lista de Verificación de Cirugía Segura se aplique correctamente, pues, ante la aclaración de los beneficios y riesgos a los que se enfrentará, es Depende del paciente decidir si acepta o no el procedimiento, así como le informará sobre el procedimiento a realizar y lo convertirá en un miembro activo del procedimiento para verificar la cirugía libre de errores evitables.Termo de Consentimento Informado é um documento que pretende informar ao paciente que vai ser submetido a algum procedimento cirúrgico os riscos e benefícios daquele tratamento. É um dever não só ético, como também legal dos profissionais da saúde atuantes nos serviços de Cirurgia. O termo de consentimento informado é fundamentado no princípio da autonomia do paciente, isto é, o paciente tem livre arbítrio para tomar decisões sobre seu corpo e seu tratamento. Identificar aspectos éticos e legais relacionados ao Termo de Consentimento Informado e sua importância para garantia de Cirurgia Segura. Nesse estudo, foi realizado revisão bibliográfica analisando artigos de revistas científicas e nas bases SCiELO e Google acadêmico sobre o termo de consentimento informado aos usuários que serão submetidos a procedimentos no Centro Cirúrgico e sua relevância para a garantia da aplicação do check list de Cirurgia Segura. No estudo evidenciou-se que é de grande importância que as informações, procedimentos e tratamentos o qual esse paciente será submetido seja registrado de forma clara, abrangente e em termos que possa ser compreendido por ele ou seu representante legal, o Termo de Consentimento Informado corretamente escrito, traz segurança para o paciente e principalmente para o profissional médico, que poderá futuramente utilizá-lo em sua defesa judicial ou representação no conselho de classe, caso haja um suposto erro médico.
