Resumo: | In this article we aim to reflect on the relationship between the role of the State in society and the control established by the Capitalist Mode of Production in the contemporary world, passing through the conceptual evolution of the State, its liberal democratic form manifested in the field of the right to freedom, soon contained by class interests and contradictorily merged with rights conquered by civil society movements. It takes as its real basis the denial of rights, freedom, the social crisis and the feeling of fear and insecurity that affects people's lives. It starts from the abstract and historical analysis of the State, moving on to the configuration of rights and their denial under neoliberalism, when society produces forms of power and surveillance to obtain legitimacy and control over individuals. We observe that addressing social rights in a historical moment in which hegemony is stronger and more complex has become a great challenge, which requires the search for a new subjectivity to combat capitalism and its forms of imposition of prejudices and social discrimination. and politicians that reinforce the influence of the most reactionary social sectors in our country. |

Toma como base real la negación de los derechos, la libertad, la crisis social y el sentimiento de miedo e inseguridad que afecta la vida de las personas. Se parte del análisis abstracto e histórico del Estado, para pasar a la configuración de los derechos y su negación en el neoliberalismo, cuando la sociedad produce formas de poder y vigilancia para obtener legitimidad y control sobre los individuos. Observamos que abordar los derechos sociales en un momento histórico en el que la hegemonía es más fuerte y más compleja se ha convertido en un gran desafío, que exige la búsqueda de una nueva subjetividad para combatir el capitalismo y sus formas de imposición de prejuicios y discriminación social y política que los refuerza. la influencia de los sectores sociales más reaccionarios de nuestro país.Neste artigo temos o objetivo de realizar reflexões sobre a relação entre o papel do Estado na sociedade e o controle estabelecido pelo Modo Capitalista de Produção no mundo contemporâneo, passando pela evolução conceitual do Estado, sua forma liberal democrática manifesta no campo do direito à liberdade, logo contida pelo interesse de classe e contraditoriamente fundida com direitos conquistados por movimentos da sociedade civil. Toma por base real a negação dos direitos, da liberdade, a crise social e a sensação de medo e insegurança que afeta a vida das pessoas. Parte da análise abstrata e histórica do Estado, passando para a configuração dos direitos e sua negação na vigência do neoliberalismo, quando a sociedade produz formas de poder e de vigilância para obter a legitimidade e o controle sobre os indivíduos.
