Criminal protection as a factor in environmental education in Brazilian society

Resumo: | The environment is constituted as a founding idea linked to the very need for survival of humanity itself, and therefore, it presents itself as a form of action with special relevance for any State. In turn, criminal law, as the most intense and incisive arm available to the Public Power in the search for social pacification, must serve not only as a purely repressive mechanism, but also, and in the environmental case more prominently, as a pedagogical factor aimed at the creation of a general awareness that protects the environmental legal asset, helping environmental education. In this way, with the almost conflicting junction of these two branches of knowledge (education and criminal law), we can see the social possibility of a movement, of an essential character, in the consolidation of a feeling of all for the protection of the environment, through behaviors focused on the transversality of environmental education, and thus meeting the ethical-social function of criminal law. |

A su vez, el derecho penal, como el brazo más intenso e incisivo de que dispone el Poder Público en la búsqueda de la pacificación social, debe servir no sólo como mecanismo puramente represivo, sino también, y en el caso ambiental de manera más destacada, como factor pedagógico. dirigido a la creación de una conciencia general que proteja el bien jurídico ambiental, ayudando a la educación ambiental. De esta forma, con la unión casi conflictiva de estas dos ramas del saber (educación y derecho penal), se vislumbra la posibilidad social de un movimiento, de carácter esencial, en la consolidación de un sentimiento de todos por la protección de la medio ambiente, a través de conductas enfocadas a la transversalidad de la educación ambiental, y así cumplir con la función ético-social del derecho penal.O meio ambiente se constitui como uma ideia fundante vinculada à própria necessidade de sobrevivência da própria humanidade, e assim sendo, se entremostra como uma forma de atuação com especial relevância de qualquer Estado. Por sua vez, o direito penal, como o braço mais intenso e incisivo de que dispõe o Poder Público para a busca da pacificação social, deve servir não somente como mecanismo puramente repressivo, mas também, e no caso ambiental de maneira mais destacada, como fator pedagógico visando a criação de uma consciência geral protetiva do bem jurídico ambiental, auxiliando a educação ambiental.
