The Configuration of Moral Damage in the Prohibition of Use of Female Bathrooms by Transexual Employees: analysis of a decision handed down by a Regional Labor Court

Resumo: The present work aims to face the theme of the use of bathrooms according to the gender identified in the work environment, starting from the analysis of two legal speeches: one, the understanding that the prohibition of the use of the feminine bathroom by a transsexual employee characterizes off-balance damage, due to affront to the value of human dignity and the right to equality; two, the understanding that moral damage cannot be characterized, given that the said prohibition on the part of the employer is justified due to the preservation of the right to privacy of other users of the bathroom. For this purpose, the proposed investigation will take place through the case study methodology, based on the analysis of the judgment issued in the judgment of Ordinary Appeal No. 000093977.2012.5.09.0003 by the 1st Panel of the Regional Labor Court of the 9th Region. The judgment that is the subject of this article demonstrates that the issue is not peaceful. The first degree decision denied the configuration of moral damage, the second degree judgment recognized it, but, even so, with divergence between the Judges that compose the collegiate judgment body. Finally, the decision that is the object of this investigation is in tune with the need to recognize transsexual workers as human persons like any other and, therefore, cannot suffer discrimination and have their dignity harmed in the work environment.

Finally, the decision that is the object of this investigation is in tune with the need to recognize transsexual workers as human persons like any other and, therefore, cannot suffer discrimination and have their dignity harmed in the work environment.El presente trabajo tiene como objetivo enfrentar el tema del uso de baños de acuerdo con el género identificado en el ambiente de trabajo, comenzando por el análisis de dos discursos legales: uno, el entendimiento de que la prohibición del uso del baño femenino por parte de una empleada transexual caracteriza el daño fuera de balance, debido a la afrenta al valor de la dignidad humana y el derecho a la igualdad; dos, la comprensión de que el daño moral no puede caracterizarse, dado que dicha prohibición por parte del empleador se justifica debido a la preservación del derecho a la privacidad de otros usuarios del baño. Para este propósito, la investigación propuesta se llevará a cabo a través de la metodología del estudio de caso, basada en el análisis de la sentencia emitida en la sentencia de Apelación Ordinaria No. 000093977.2012.5.09.0003 por el 1er Panel del Tribunal Regional del Trabajo de la Novena Región. El juicio que es el tema de este artículo demuestra que el tema no es pacífico. La decisión de primer grado negó la configuración del daño moral, el juicio de segundo grado lo reconoció, pero, aun así, con la divergencia entre los jueces que componen el cuerpo colegiado de juicio. Finalmente, la decisión que es el objeto de esta investigación está en sintonía con la necesidad de reconocer a los trabajadores transexuales como personas humanas como cualquier otra y, por lo tanto, no pueden sufrir discriminación y dañar su dignidad en el entorno laboral.O presente trabalho objetiva enfrentar, partir da análise de dois discursos jurídicos: um, o entendimento de que a proibição de utilização do banheiro feminino por empregada transexual caracteriza dano extrapatrimonial, por afronta ao valor da dignidade humana e ao direito à igualdade; dois, o entendimento de que o dano moral não pode ser caracterizado, tendo em vista que a referida proibição por parte do empregador justifica-se em razão da preservação do direito à privacidade das demais usuárias do banheiro. Para tanto, a investigação proposta se dará através da metodologia do estudo de caso, a partir da análise do acórdão proferido no julgamento do Recurso Ordinário nº 0000939­77.2012.5.09.0003 pela 1ª Turma do Tribunal Regional do Trabalho da 9ª Região. O julgamento objeto deste artigo demonstra que o tema não é pacífico. A decisão de primeiro grau negou a configuração de dano moral, o acórdão de segundo grau a reconheceu, mas, ainda assim, com divergência entre os Desembargadores componentes do órgão de julgamento colegiado.
