Judicialización del acceso a procedimientos quirúrgicos ortopédicos en un instituto especializado en traumatología y ortopedia del Sistema Único de Salud (SUS)

Resumo: The present study aims to evaluate the litigation of orthopedic surgical procedures within the Brazilian healthcare system from demands presented to the National Institute of Orthopedics and Traumatology (INTO), from January 2014 to December 2017. The study was a documentary research, with an exploratory, descriptive and retrospective nature, complemented by the examination of lawsuit requirements, medical records and the local hospital management software system. Out of the 1,886 lawsuits identified, 1,175 had direct relation to healthcare and 109 demanded orthopedic surgical procedures. Out of the demanded cases, most were requested by the Federal Public Defender’s Office. Amongst the requesters, most of them were male, with 60 years of age or older and retired, with hip and/or knee arthroplasty corresponding 47,7% out of the requests. Out of the total, 86,2% of the requests demanded were proceeded. The time median, upon the lawsuit arrival at INTO, ranged from 8 to 30 days to patients previously consulted at INTO and from 8 to 23 days for those coming from other institutions and without any internal medical record. The study showed how lawsuit litigation for surgical procedures may lead not only to a negative impact on an institution’s patient care management but also on the patient’s surgical waiting list. It is important to ponder the excluding factor of such activity, which ends up reallocating assets not considering the principle of equity, to demand a surgical procedure in one patient whilst others, who are in similar or even worse conditions to those benefited from lawsuits, have got to wait longer on the waiting line.

Se trata de un estudio exploratorio, descriptivo y retrospectivo, de carácter documental, basado en datos obtenidos de historias clínicas, sistemas de información y gestión hospitalaria y judicial. De los 1886 casos remitidos al INTO, 1175 tenían relación directa con el objeto salud, y 109 con demandas para procedimientos quirúrgicos. Entre los casos demandados, la mayoría fue emitida por la Defensoría Pública de la Unión. El perfil predominante fue el de pacientes masculinos, mayores de 60 años y jubilados, con artroplastias de cadera y rodilla correspondientes al 47,7% del total de casos identificados.  De todos los procesos, 86,2% fueron atendidos y con medianas de tiempo, desde su recepción por el INTO, variando de 8 a 30 días para los pacientes registrados, y de 8 a 23 días cuando eran externos a la institución. El estudio mostró cómo el proceso de judicialización de los procedimientos quirúrgicos puede impactar en la gestión asistencial de una institución y de los pacientes en lista de espera. Debe tenerse en cuenta el carácter excluyente de esta medida, que implica una asignación de recursos desconociendo el principio de equidad, al determinar la realización del procedimiento sin considerar a los demás pacientes que se encuentran en lista de espera, en condiciones similares o incluso más graves que los que se benefician.O objetivo do presente estudo foi avaliar a judicialização de procedimentos cirúrgicos ortopédicos no âmbito do sistema de saúde brasileiro, a partir das demandas apostas ao Instituto Nacional de Traumatologia e Ortopedia (INTO), entre janeiro/2014 e dezembro/2017. Trata-se de estudo de abordagem exploratória, descritiva e retrospectiva, de natureza documental elaborado com base nos dados obtidos em registros médicos, sistemas de informação e de gestão hospitalar e processos judiciais. Dos 1886 casos encaminhados ao INTO, 1175 tinham relação direta o objeto saúde, e 109 de demandas para procedimentos cirúrgicos. Dentre os casos demandados, a maioria foi emitida pela Defensoria Pública da União. O perfil prevalente foi de pacientes do sexo masculino, acima de 60 anos de idade e aposentados, com as artroplastias de quadril e joelho correspondendo a 47,7% do total de casos identificados. De todos os processos, 86,2% foram atendidos e com medianas de tempo, desde seu recebimento pelo INTO, variando de 8 a 30 dias para os pacientes cadastrados, e de 8 a 23 dias quando eram externos à instituição. O estudo mostrou como o processo da judicialização de procedimentos cirúrgicos pode impactar na gestão da assistência de uma instituição, e dos pacientes na lista de espera.
