“My boat I do not leave”: right of land use in the Serra do Pardo National Park by the beiradeiros, Pará, Brasil

Resumo: This paper analyses which territorial rights have the beiradeiros from Saint Sebastian village, located today in the Serra do Pardo National Park (SPNP), between São Felix do Xingu and Altamira (Pará). Field research have been effected, through targeted conversations with the beiradeiros, in order to understand their territorialization process and verify if they can been seeing as traditional people. Bibliographical research has also been effected, specially about the art. 42 of Law nr. 9.985/2000 validity, in order to verify the possibility of the sustainable use of the environment and of the natural resources of the areas used by them, instead of their resettlement. It was concludes that those beiradeiros are Amazon traditional population and that they can use rationally the natural resources from the SPNP, what doctrine and jurisprudence named double affection of the conservation units.

It was concludes that those beiradeiros are Amazon traditional population and that they can use rationally the natural resources from the SPNP, what doctrine and jurisprudence named double affection of the conservation units.El presente trabajo busca analizar qué derechos territoriales poseen los barrios de la villa de São Sebastião, situada hoy en el interior del Parque Nacional de la Sierra del Pardo (PNSP), entre los municipios de São Félix del Xingu y Altamira (Pará). Se realizaron investigaciones de campo, por medio de conversaciones dirigidas con los barrios, a fin de entender su proceso de territorialización y verificar si ellos pueden ser caracterizados como pueblo tradicional. También se realizaron investigaciones bibliográficas, sobre todo sobre la validez del art. De la Ley nº 9.985 / 2000, para verificar la posibilidad del uso sostenible del medio ambiente y de los recursos naturales de las áreas que son utilizadas por los aleros, sin la necesidad de su reubicación. Se concluyó que esos barrios son población tradicional de la Amazonía y que hay posibilidad de que esta población haga uso racional de los recursos naturales en las áreas del PNSP, lo que la doctrina y la jurisprudencia nombraron de doble afectación de las unidades de conservación.O presente trabalho busca analisar quais direitos territoriais possuem os beiradeiros da vila de São Sebastião, situada hoje no interior do Parque Nacional da Serra do Pardo (PNSP), entre os municípios de São Félix do Xingu e Altamira (Pará). Foram realizadas pesquisas de campo, por meio de conversas direcionadas com os beiradeiros, a fim de entender o seu processo de territorialização e verificar se eles podem ser caracterizados como povo tradicional. Também foram realizadas pesquisas bibliográficas, sobretudo acerca da validade do art. 42 da Lei nº 9.985/2000, para verificar a possibilidade do uso sustentável do meio ambiente e dos recursos naturais das áreas que são utilizadas pelos beiradeiros, sem a necessidade do seu remanejamento.
