The presence of Forensic Medicine as a discipline in Law courses: analysis of its importance for Criminal Procedural Law and the expertise of the Brazilian justice system, alluding to the Isabella Nardoni case

Resumo: | Objective: The purpose of this article is to analyze the presence of the discipline of Legal Medicine (ML) in Higher Education Institutions (HEIs) in the northeast region of Brazil, as well as to better elucidate the positive influence that ML has in solving concrete cases in the process penal. Methodology: Through the electronic database of the Ministry of Education (e-MEC), all Northeastern HEIs with degrees in Law were collected, followed by the consultation of the curriculum on the website of each institution. The presence of the ML discipline in the curricular matrix, its workload, mandatory teaching and the period in which it is taught were evaluated. In addition, the case of the “Nardoni couple” was analyzed, discussing the necessity of ML to reach the real procedural truth. Results: 264 colleges were included, where only 91 have an exclusive subject for teaching it. Among the colleges in which it is taught, its mandatory presence is present in only 45.7% of graduations. The average workload was 49.7 class hours, representing only 1.2% of the total hours of the curriculum structure. Conclusion: It is possible to verify that the teaching of Legal Medicine is not in preponderance in the HEIs in the Northeast, it is up to the Bachelor of Laws to seek further training on the subject. |

Metodología: A través de la base de datos electrónica del Ministerio de Educación (e-MEC), se recopilaron todas las IES del Nordeste con títulos en Derecho, seguido de la consulta del plan de estudios en el sitio web de cada institución. La carga de trabajo promedio fue de 49,7 horas de clase, lo que representa solo el 1,2% del total de horas de la estructura curricular. Conclusión: Es posible constatar que la docencia de la Medicina Legal no está en preponderancia en las IES del Nordeste, le corresponde al bachillerato en derecho buscar una mayor formación en el tema.Objetivo: O presente artigo tem por escopo analisar a presença da disciplina de Medicina Legal (ML) nas Instituições de Ensino Superior (IES) da região nordeste brasileira, bem como melhor elucidar a influência positiva que a ML possui na resolução de casos concretos do processo penal. Metodologia: Por meio da base de dados eletrônica do Ministério da Educação (e-MEC), coletou-se todas as IES nordestinas com graduação em Direito, seguido pela consulta da grade curricular no site de cada instituição. Foram avaliados presença da disciplina ML na matriz curricular, sua carga horária, obrigatoriedade de ensino e período em que é lecionada. Além disso, analisou-se o caso do “casal Nardoni”, discutindo a imprescindibilidade da ML para o alcance da verdade processual real. Resultados: Incluíram-se 264 faculdades, onde apenas 91 possuem disciplina exclusiva para o ensino da mesma. Dentre as faculdades em que é lecionada, a sua obrigatoriedade está presente em apenas 45,7% das graduações. A carga horária média foi de 49,7 horas/aula, representando somente 1,2% do total de horas da estrutura curricular.
