Euthanasia and orthothanasia: the balance between the right to life and the principle of human dignity

Resumo: | Human life is a right extremely protected by the Brazilian legal system, mainly by its Federal Constitution. However, when talking about dignified death, it is questioned to what extent this right is limited, in view of the principle of human dignity and autonomy of will. Thus, given the technological advances in the field of medicine, the evolution of society and the need for new discussions on the subject in the legal field, this paper seeks to debate and observe the limits of the right to life and the dignity of the human person in the face of modalities of Euthanasia and Orthothanasia, exploring the concepts of these modalities of abbreviating death, their origins, the world view of each of them, as well as understanding their legal position in the face of the Brazilian law. The methodology used was the review of bibliographies such as doctrines, laws and recent articles, for a better theoretical and legal basis for the work. |

Sin embargo, cuando se habla de una muerte digna, se cuestiona en qué medida se limita este derecho, en atención al principio de la dignidad humana y la autonomía de la voluntad. De esta forma, dados los avances tecnológicos en el campo de la medicina, la evolución de la sociedad y la necesidad de nuevas discusiones sobre el tema en el ámbito jurídico, el presente trabajo busca debatir y observar los límites del derecho a la vida y a la dignidad. de la persona humana frente a las modalidades de Eutanasia y Ortotanasia, explorando los conceptos de estas modalidades de abreviatura de la muerte, sus orígenes, la cosmovisión de cada una de ellas, así como la comprensión de su posición jurídica en el ordenamiento jurídico brasileño. Se utilizó como metodología, la revisión de bibliografías como doctrinas, leyes y artículos recientes, para una mejor fundamentación teórica y legal del trabajo.A vida humana é um direito extremamente protegido pelo ordenamento jurídico brasileiro, principalmente por sua Constituição Federal. Entretanto, quando se fala de morte digna, questiona-se até que ponto tal direito se limita, em vista do princípio da dignidade da pessoa humana e da autonomia da vontade. Dessa forma, diante dos avanços tecnológicos no campo da medicina, da evolução da sociedade e da necessidade de novas discussões sobre o tema no âmbito jurídico, o presente trabalho busca debater e observar os limites do direito à vida e da dignidade da pessoa humana diante das modalidades da Eutanásia e da Ortotanásia, explorando os conceitos dessas modalidades de abreviação da morte, as suas origens, a visão mundial de cada uma delas, bem como entender o seu posicionamento jurídico diante do ordenamento brasileiro.
