The use of artificial intelligence as a tool for efficiency and access to justice in a systematic literature review

Resumo: | In contemporary times, public organizations have directed their efforts toward replacing bureaucratic public administration with managerial public administration based on effective results. Within the scope of the Judiciary, this reality is linked to issues such as guaranteeing the fundamental rights of citizens, which, in order to be realized, require a change in attitude that ensures access to justice, embodied in an effective response from the Judiciary and within a perspective of reasonable duration of the process. In view of this, the discussions and the search for technological solutions to the inefficiency and slowness of proceedings, with the help of artificial intelligence tools, have been intensifying, nationally and internationally, since algorithms present good perspectives for the improvement of the jurisdictional provision and access to justice. The method used was a systematic review of quantitative and qualitative literature, conducted on the Web of Science, Scopus, and Theses and Dissertations Databases, using the last five years as a time frame. In the international research findings, possibilities were found such as intelligent readers, automated searches with e-discovery to access previous data, in addition to data mining and processes that can support the decision making of judges. In Brazil, it was found that there has been a significant evolution in the use of algorithms over the past five years, most of it supported by the system of judicial precedents and procedural screening. Finally, it is verified the importance of regulatory measures of ethical character, to be observed by artificial intelligence developers, in order to prevent unwanted reflexes. |

En el ámbito del Poder Judicial, esta realidad está ligada a cuestiones como la garantía de los derechos fundamentales del ciudadano, que para materializarse requieren un cambio de actitud que garantice el acceso a la justicia, plasmado en una respuesta eficaz del Poder Judicial y dentro de una perspectiva de duración razonable del proceso. Por ello, se han intensificado los debates y la búsqueda de soluciones tecnológicas en relación con la ineficacia y la lentitud de los procedimientos, con la ayuda de herramientas de inteligencia artificial, a nivel nacional e internacional, ya que los algoritmos presentan buenas perspectivas para la mejora de la prestación jurisdiccional y el acceso a la justicia. El método utilizado fue una revisión sistemática de la literatura cuantitativa y cualitativa, realizada en las plataformas Web of Science, Scopus y Theses and Dissertations Bank, con los últimos cinco años como marco temporal. En los resultados de la investigación internacional, se encontraron posibilidades como los lectores inteligentes, las búsquedas automatizadas con e-discovery para acceder a datos anteriores, además de la minería de datos y los procesos que pueden subvencionar el proceso de toma de decisiones de los jueces. En Brasil, se verificó que ha habido una evolución significativa en el uso de algoritmos en los últimos cinco años, la mayor parte de ellos sostenidos en el sistema de precedentes judiciales y de selección procesal. Por último, se comprueba la importancia de las medidas reguladoras de carácter ético, que deben observar los desarrolladores de inteligencia artificial, para evitar reflejos indeseados.Na contemporaneidade, as organizações públicas têm direcionado seus esforços para substituir uma administração pública burocrática pela administração pública gerencial pautada em resultados efetivos. No âmbito do Poder Judiciário, essa realidade está atrelada a questões como garantia dos direitos fundamentais do cidadão, que para serem concretizados exigem uma mudança de postura que assegure acesso à justiça, consubstanciado em uma resposta do Judiciário de forma eficaz e dentro de uma perspectiva de duração razoável do processo. Diante disso, as discussões e a busca por soluções tecnológicas quanto a ineficiência e a morosidade processual, com o auxílio de ferramentas de inteligência artificial, vêm se intensificando, nacional e internacionalmente, posto que os algoritmos apresentam boas perspectivas para o aprimoramento da prestação jurisdicional e do acesso à justiça. O método utilizado foi uma revisão sistemática da literatura quantitativa e qualitativa, realizada nas plataformas Web of Science, Scopus e Banco de Teses e Dissertações, tendo como marco temporal os últimos cinco anos. Nos achados internacionais da pesquisa, foram encontradas possibilidades como leitores inteligentes, buscas automatizadas com o e-discovery para acesso a dados anteriores, além de mineração de dados e de processos que possam subsidiar a tomada de decisão de juízes. No Brasil, verificou-se que houve uma evolução significativa do uso dos algoritmos ao longo dos últimos cinco anos, a maior parte deles sustentado no sistema de precedentes judiciais e triagem processual.
