Judicialization of access to medicines: Matter of law versus public health issue

Resumo: In the context of the fight against military dictatorship, the Brazilian Health Reform took place in the 1970s, a period marked by the population's desire for more social rights, including the right to health. Thus, the Magna Carta presents health as a right of all and a duty of the state, establishing the bases for the creation of the Unified Health System (SUS). In situations where the State is unable to provide health services, including the supply of medicines, the phenomenon of judicialization of health emerges, where the judiciary acts to guarantee access to medicine. Thus, the objective of this research was to carry out a bibliographical research on the judicialization of access to medicines in Brazil. The study presents the bases of the fundamental right to health, combined with the understanding of higher courts that point to a congestion of processes with this object, amidst a scenario of State failure to provide medicines. Judicialization appears to be a tool capable of ensuring the right to health despite there currently being pending consideration of topic 1,234 in the STF. On the other hand, it is essential that the State understands the importance of public health in Brazil, reinforcing intersectoral cooperation to establish more appropriate criteria for the management of health resources and the adequate materialization of the right to health in the provision of medicines.

La Carta Magna presenta la salud como un derecho de todos y un deber del Estado, estableciendo las bases para la creación del Sistema Único de Salud (SUS). En situaciones en las que el Estado no puede brindar servicios de salud, incluido el suministro de medicamentos, surge el fenómeno de la judicialización de la salud, donde el poder judicial actúa para garantizar el acceso a los medicamentos. Así, el objetivo de esta investigación fue realizar una investigación bibliográfica sobre la judicialización del acceso a los medicamentos en Brasil. El estudio presenta los fundamentos del derecho fundamental a la salud, combinados con la comprensión de los tribunales superiores que señalan una congestión de los procesos con ese objeto, en medio de un escenario de falta de provisión de medicamentos por parte del Estado. La judicialización parece ser una herramienta capaz de garantizar el derecho a la salud a pesar de que actualmente está pendiente de consideración el tema 1.234 en el STF. Por otro lado, es fundamental que el Estado comprenda la importancia de la salud pública en Brasil, reforzando la cooperación intersectorial para establecer criterios más adecuados para la gestión de los recursos sanitarios y la adecuada materialización del derecho a la salud en la provisión de medicamentos.No contexto da luta contra ditadura militar ocorreu a Reforma Sanitária brasileira nos anos 70, período marcado pelo anseio da população por mais direitos sociais, incluindo direito à saúde. A Carta Magna apresenta a saúde como um direito de todos e dever do estado, instituindo as bases de criação do Sistema Único de Saúde (SUS). Em situações que o Estado se mostra inapto a prestar serviços de saúde, incluindo o fornecimento de medicamentos, surge o fenômeno da judicialização da saúde, onde há atuação do judiciário para garantir o acesso ao medicamento. Assim, o objetivo da presente pesquisa foi realizar uma pesquisa bibliográfica sobre a judicialização do acesso à medicamentos no Brasil. O estudo apresenta as bases do direito fundamental à saúde, aliada ao entendimento dos tribunais superiores que apontam para uma congestão de processos com esse objeto, em meio a um cenário de omissão do Estado em fornecer medicamentos. A judicialização se mostra como uma ferramenta capaz de assegurar o direito à saúde apesar de atualmente haver pendência na apreciação do tema 1.234 no STF.
