The problem of legal recognition by France regarding indigenous peoples living on the border between Brazil and French Guiana

Resumo: The present research aimed to analyze the legal treatment given to indigenous populations in the border region between Brazil and French Guiana, especially with regard to the non-recognition of indigenous peoples by France due to constitutional limitations and, by Consequently, the non-ratification by that country of Convention 169 of the International Labor Organization – ILO. The methodology used was the deductive method; as for the means of research, it was bibliographic, using doctrine, articles, books, legislation and jurisprudence; and as for the purposes, it was a qualitative research. It was possible to conclude that the lack of adequate guarantee of the rights of indigenous peoples by France causes damage to the preservation of the culture and language of these peoples, with the potential to affect the indigenous populations on the Brazilian side of the border. This proves to be a hindrance to the adoption of specific public policies aimed at these populations by the French State.

This proves to be a hindrance to the adoption of specific public policies aimed at these populations by the French State.La presente investigación tuvo como objetivo analizar el tratamiento legal otorgado a las poblaciones indígenas en la región fronteriza entre Brasil y la Guayana Francesa, especialmente en lo que se refiere al no reconocimiento de los pueblos indígenas por parte de Francia debido a limitaciones constitucionales y, por consiguiente, la no ratificación por ese país del Convenio 169 de la Organización Internacional del Trabajo – OIT. La metodología utilizada fue el método deductivo; en cuanto al medio de investigación, fue bibliográfico, utilizando doctrina, artículos, libros, legislación y jurisprudencia; y en cuanto a los fines, fue una investigación cualitativa. Fue posible concluir que la falta de garantía adecuada de los derechos de los pueblos indígenas por parte de Francia causa daños a la preservación de la cultura y la lengua de estos pueblos, con el potencial de afectar a las poblaciones indígenas del lado brasileño de la frontera. Esto resulta ser un obstáculo para la adopción de políticas públicas específicas dirigidas a estas poblaciones por parte del Estado francés.A presente pesquisa teve por objetivo analisar o tratamento legal dispensado às populações indígenas na região de fronteira entre o Brasil e a Guiana Francesa, em especial no que diz respeito ao não reconhecimento dos povos indígenas pela França em razão de limitações de ordem constitucional e, por consequência, a não ratificação, por esse país, da Convenção 169 da Organização Internacional do Trabalho – OIT. A metodologia utilizada foi a do método dedutivo; quanto aos meios de pesquisa foi bibliográfica, com uso de doutrina, artigos, livros, legislação e jurisprudência; e quanto aos fins tratou-se de uma pesquisa qualitativa. Foi possível concluir que a falta de garantia adequada dos direitos dos povos indígenas pela França causa prejuízos à preservação da cultura e idioma desses povos, com potencial de afetar as populações autóctones do lado brasileiro da fronteira.
