Resumo: Throughout the 19th century, indigenous peoples living in Rio de Janeiro suffered a violent process of land expropriation – mostly backed by legal procedures. This work aims to rescue this process, accompanying the actions taken by the Imperial State to vacate indigenous lands and allocate them to new owners. In this scenario, we should also account for the role of the District Ombudsman and the Orphan’s Court, entities entitled to protect indigenous heritage, in dismantling the heritage of populations living in reductions in Rio de Janeiro during the 19th century – an important investigative path to unravel this issue.

Esse texto pretende recuperar esse processo acompanhando o movimento do Estado imperial no sentido de promover a desocupação dos territórios das aldeias e sua concessão a novos proprietários. Ao mesmo tempo que o Império retirava dos índios o direito à terra, havia ainda que se considerar a atuação das ouvidorias de comarca e do Juízo dos Órfãos, instâncias cujas atribuições incluíam a proteção do patrimônio indígena.
