Resumo: Abstract: This article analyzes the Chilean agencies liability arising from the lack of access to drinking water for human consumption, regarding the vulnerable rural communities that were protagonists of the so-called “Petorca case”, adjudicated in March 2021 by the Supreme Court. This article takes aim to determine if, in this case, there are grounds  for alleged liability for lack of service for said agencies that, concurring the other elements, would make it appropriate to pay compensation for damages in favor of the people of these communities, as a result of an illegitimate activity that violates their fundamental right to drinking water.

El trabajo persigue determinar si, en este caso, existen bases que permitan establecer una presunta responsabilidad por falta de servicio de dicha Administración, la que, de concurrir los demás elementos, harían procedente el pago de una indemnización de perjuicios en favor de las personas de dichas comunidades, como consecuencia de una actividad ilegítima vulneratoria de su derecho fundamental al agua potable.Este artículo analiza la responsabilidad extracontractual delaAdministración Pública chilena, derivada de la falta de acceso al agua potable para consumo humano, respecto de las comunidades rurales vulnerables que protagonizaron el denominado “caso Petorca”, resuelto en marzo de 2021 por la Corte Suprema.
