Of false promises of employment and their relationship with trafficking in human beings, before the Covid-19 pandemic.

Resumo: There is a problem that has been afflicting thousands of people for centuries – the vast majority from human groups – which is human trafficking. In addition to the victims' pension, unemployment, social inequality, the prospect of improvement, financial instability and political inconstancy contribute to more becoming victims of causes.Since mid-March 2020, a serious problem arising from the COVID-19 pandemic has been noticed - which in addition to thousands of deaths has led to poverty - due to the closing of jobs and the consequent increase in unemployment. So, obviously, such a social problem will significantly increase the possibility of more people becoming victims of human traffickers when they are deceived by false promises of employment.This article seeks not only to prevent those who can be misled, but also to sensitize the Authorities involved in the investigation of the specific case that, behind a mere empty promise of employment, there may be the scope of the practice of crimes. For that, we used the investigation of factual and real situations of the concrete world and we used the analysis of jurisprudence, doctrinal explanations and the appreciation of concrete data; aiming to demonstrate the need to be aware of the false promises of employment that will appear, which may be masked and which will have the sole purpose of exploiting people for the trafficking of human beings.

Além da fragilidade das vítimas tem-se que o desemprego, a desigualdade social, a falta de perspectiva de melhorias, a instabilidade financeira e a inconstância política contribuem para que mais pessoas se tornem vítimas dos criminosos. Percebe-se desde meados do mês de março de 2020 um grave problema oriundo da pandemia da Covid-19 – que além de milhares de mortes direcionou outras tantas à pobreza – em razão do fechamento de postos de trabalho e consequente aumento do desemprego. Assim, por óbvio, tal problemática social ampliará significativamente a possibilidade de mais pessoas tornarem-se vítimas dos traficantes de pessoas ao serem ludibriadas por falsas promessas de emprego. Busca-se no presente artigo não apenas prevenir aqueles que podem ser induzidos a erro, mas também sensibilizar as autoridades envolvidas na investigação do caso concreto de que, por trás de uma mera promessa vazia de emprego, pode existir o escopo da prática de crimes. Para tanto, empregamos a averiguação de situações fáticas e reais do mundo concreto e utilizamos a análise de jurisprudências, explanações doutrinárias e da apreciação de dados concretos, visando a demonstrar a necessidade de estarmos atentos às falsas promessas de emprego que surgirão, as quais poderão estar mascaradas e que terão como único fim a exploração de pessoas para o tráfico de seres humanos.
