The interdependence between the elements of the “application” and the “effectiveness” of humanitarian standards in the light of a practical perspective

Resumo: The research in the area of Law aims to demonstrate that, in order to achieve a real understanding of humanitarian norms, it is essential to combine the legal elements of application and effectiveness. In fact, this work intends to analyse the norms of International Humanitarian Law, in order to verify factual situations that are under the incidence of this regulation, constituting the analysis of the hypotheses of application of the humanitarian rules, a presupposition for the investigation of the effectiveness of this normative set in the international scope. As a result, it comes up against the inquiry into the possible sanctions in case of non-compliance with the legal regulation, of which the possibility of criminal liability needs to understand the legal concept of the act typified as a war crime. Within this perspective, this research will use the deductive scientific method, with a rationalist perspective as the only way to reach knowledge, resorting to the descending chain of reasoning, from general to particular analysis, through the use of syllogism.

Com efeito, este trabalho pretende analisar as normas de Direito Internacional Humanitário, de modo a verificar situações fáticas que estão sob a incidência desse regramento, constituindo a análise das hipóteses de aplicação das regras humanitárias, um pressuposto para a investigação da eficácia desse conjunto normativo no âmbito internacional. Como resultado, esbarra-se na perquirição acerca das possíveis sanções em caso de inobservância ao regramento jurídico, do qual a possibilidade de responsabilização penal necessita compreender o conceito jurídico do ato tipificado como crime de guerra.
