Resumo: The purpose of this work consist in present the boundaries of right of assembly in the brazilian legal system, specifically about his implicit demarcations, seeing that they projects themselves in the norms of recognition of the nation, this last one that will be analyzed from the notions that permeate the constitution of the legal subject, demonstrating that the current logic of the application of the right of assembly is insufficient with regard to the exercise by unrecognized bodies. Then, from the adoption of the theory of the performativity of bodies proposed by Judith Butler, an extensive and inclusive interpretation of the human is proposed, which, through the performative exercise of the right to appear, brings those abject subjects to the sphere of appearance. guaranteeing recognition within the legal field.
