The treatment of eletronic waste on the national solid waste policy

Resumo: | It is public knowledge that technological advances in the past decades have led to an exponential increase in the consume of electronics equipment. In fact, the very act of consuming has taken on a new meaning in post-modern society, establishing a different widespread and widely adopted standard of living. The result of these changes took place in the progressive accumulation of so-called e-waste. In the light of the above, it sought to question in which evolutionary stage the Brazilian environmental legislation is in relation to the management of this new type of waste. The justification for such concern rests not only in the fact of technological waste present peculiar characteristics different of other types of waste, but also - and mainly - because it is widely consumed and discarded today. Generally speaking, one can say that the Brazilian legal system has developed in recent times legislation to draw principles, objectives and guidelines for the environmentally sound management and handling of various types of solid waste, including the waste electrical and electronic equipment - WEEE. Thus, was constituted objective of this study to observe the rules and regulations concerning the management of this type of waste. For this, it was analyzed the Law 12.305/10, especially with regard to the institution of shared responsibility and reverse logistics system. The preparation of this work was through the deductive method and the research were made in doctrines, periodicals, case law and other relevant sources to the subject. |

Em verdade, o próprio ato de consumir assumiu uma nova conotação na sociedade pós-moderna, estabelecendo um diferente padrão de vida largamente adotado e difundido. O reflexo dessas mudanças se deu no progressivo acúmulo do chamado lixo tecnológico. Em função do exposto, buscou-se questionar em qual estágio evolutivo a legislação ambiental brasileira se encontra no que se refere ao gerenciamento desse novo tipo de resíduo. A justificativa para tal preocupação pousa não só no fato do lixo tecnológico apresentar características peculiares diferentes dos demais tipos de resíduo, mas também – e principalmente – por ser amplamente consumido e descartado nos dias atuais. Em linhas gerais, pode-se dizer que o ordenamento brasileiro elaborou em época recente uma legislação destinada a traçar princípios, objetivos e diretrizes para a gestão e manejo ambientalmente adequado de vários tipos de resíduos sólidos, dentre eles, o resíduo de equipamento eletroeletrônico – REEE. Assim, constituiu objetivo do presente trabalho observar as disposições normativas concernentes à gestão desse tipo de resíduo. Para isso, foi analisada a lei 12.305/10, mormente no que diz respeito à instituição da responsabilidade compartilhada e do sistema de logística reversa.
