The legal platform of international declarations and conventions that underpin the Federal Constitution together with the Traditional Communities

This research focuses on traditional peoples and communities in light of Decree 6.040/2007, the Federal Constitution and International Declarations and Conventions. The objective of the study is to identify what the international instruments talk about the Peoples. The methodological resource used was, the bibliographical research, carried out from the detailed analysis of authors such as Piovesan (2012), Manaus (2007), Comparato (2004) and others, as well as international legal documents, dissertations and theses. Therefore, as a conclusion of this study, it can be seen that traditional peoples and communities have protective rights that seek to recognize and value the category, and that this protection is based primarily on the federal Constitution. In this vein, Convention 169 of the International Labor Organization was the forerunner in the debate about traditional peoples and communities, strengthening the importance of recognizing the cultural plurality of different ethnic groups.
