Brazilian regulation on surrogacy

Resumo: Surrogacy is a type of assisted reproduction technique that assists reproductively challenged people into building their families. In surrogacy, a woman – called “surrogate” – carries the baby of the “intended parents”, a term that includes same-sex couples, heterosexual couples and single people in a parental journey. Brazil is considered a country with a regulatory model - instead of a prohibitive country or a no-regulation country – but with a particularity: there’s no specific law. The legal regulation is in the form of a resolution presented by the Federal Medical Council of Brazil, which means it is not legally binding, only ethically binding for doctors. The first resolution was published in 1992 and the current one is Resolution n. 2.168 of 2017. Some bills have been proposed since 1997 – usually just reproducing exactly what the resolution from the Federal Medical Council says – but none of them were approved. This way, Resolution n. 2.168/2017 is still, at the present moment, the only regulatory document about surrogacy in Brazil.

This way, Resolution n. 2.168/2017 is still, at the present moment, the only regulatory document about surrogacy in Brazil.  A gestação de substituição faz parte do rol de técnicas de reprodução assistida, que auxiliam na reprodução humana de pessoas com dificuldades reprodutivas. Na gestação de substituição, uma mulher – chamada de doadora temporária de útero – gestará o bebê de terceiros, chamados mães/pais intencionais, termo que engloba casais heterossexuais, homossexuais e pessoas solteiras em projeto parental solo. O Brasil insere-se em um modelo de regulamentação da gestação de substituição, e não de proibição ou abstenção de regulamentação, mas com uma particularidade: não há lei específica. A regulamentação jurídica é feita por meio de resoluções do Conselho Federal de Medicina, que não possuem força da lei, sendo caracterizadas pelo próprio órgão como “normas éticas”. A primeira resolução data de 1992 e a regulamentação atualmente em vigor é a Resolução nº 2.168, de 2017.  Alguns projetos de lei já foram propostos, datando o primeiro de 1997, e geralmente reproduzindo explicitamente o previsto nas resoluções do Conselho Federal de Medicina, não tendo ocorrido, até o momento, a aprovação de nenhum deles.
