Water Conflicts in Santa Catarina: a reflection from the social and environmental ethical perspective

Resumo: The paper presents a reflection based on a study on law court decisions issued by the Santa Catarina Court of Justice regarding the socio-environmental conflicts about water in this state, emphasizing the cases involving the installation of hydroelectric plants that affect riverine populations. The study found that is a very small portion of conflicts that effectively reach judicialization. These conflicts often receive treatment based on a type of legal argument that associates the general interest of the community with the interests of the power companies. As a result, the rights of affected riverine and artisanal fishers are underestimated or treated as irrelevant. Based on these data, is made a socio-environmental ethical analysis showing that: the prevailing argument presupposes an instrumental reduction of the river to a merely energy-generating entity and that there is an argumentative space to be traced defending the rivers as entities whose value It is not reduced to that easily instrumentalized by the market, which enables the valuation of multiple and diverse forms of coexistence with the river, and which guarantees human and non-human interests.

El estudio encontró que, además de ser una porción muy pequeña de conflictos que efectivamente llegan a la judicialización, los conflictos que llegan reciben tratamiento basado en un tipo de argumento legal que asocia el interés general de la comunidad con los intereses de las compañías eléctricas. Como resultado, los derechos de los pescadores ribereños y artesanales afectados son subestimados o tratados como irrelevantes. Con base en estos datos, se realiza un análisis de ética socioambiental que muestra que el argumento prevaleciente presupone una reducción instrumental del río a una entidad meramente generadora de energía y que hay un espacio argumentativo para rastrear la defensa de los ríos como entidades cuyo valor no se reduce a lo es fácilmente instrumentalizado por el mercado, sino que permite la valoración de múltiples y diversas formas de convivencia con el río que garantizan los intereses de humanos y no humanos.O trabalho apresenta uma reflexão realizada com base em estudo sobre decisões judiciais proferidas pelo tribunal de Justiça de Santa Catarina com relação aos conflitos socioambientais em torno da água no estado de Santa Catarina, dando ênfase aos casos envolvendo a instalação de hidroelétricas que afetam populações ribeirinhas. O estudo constatou que além de ser uma parcela muito pequena de conflitos que alcançam efetivamente a judicialização, os conflitos que alcançam recebem tratamento pautado por um tipo de argumentação jurídica que associa o interesse geral da comunidade aos interesses das empresas geradoras de energia. Com isto, os direitos dos ribeirinhos e pescadores artesanais afetados são subestimados ou tratados como irrelevantes.
