Social participation, State and minority rights: the democratic conformation of public policies for the LGBTI+ population in Brazil

The article deals with the formation of public policies and social rights aimed at the population of lesbians, gays, bisexuals, transvestites, transsexuals and other forms of sexual orientation and gender identity (LGBTI+) in Brazil. The objective is to present a longitudinal analysis on the subject from the re-democratization in the 1980s until 2023. To this end, it exposes bibliographical research that dealt with social participation, participatory institutions and, specifically, the relationship between participation, social rights and public policies for LGBTI+, with emphasis on the theoretical debate about the existence of waves of development both of social movements and struggles and of access to social rights and achievement of public policies. We deepened the analysis of the theoretical framework by incorporating into the debate the judicialization of advances in terms of policies and rights for the LGBTI+ population in recent decades, so that it is concluded that more effective actions are needed for the practical institutionalization of public policies and social rights for the LGBTI+ population in the country, such as expanding spaces for participation at the state and municipal levels, which poses a challenge for the formation of a democratic society in Brazil.
