This study aimed to discuss crime and use of drugs, under hermeneutic look of the currentstandards. Initially, it became relevant to understand the addiction and its close relationship incommitting a crime, which with subsequent incarceration of the agent, it is essential toanalyze the current parental rights of the normative model of the penalty and the direction ofthe addict lawbreaker, entering specifically to the rules of criminal law, which guides possiblemeasures applicable to the lawbreaker in loco. In this context, it discriminates the importanceof Therapeutic Justice, which has a preventive nature against the combat of crime and drug  use, analyzing the effects arising from the non-imprisonment of the drug addict lawbreaker byexpansion of alternative measures, front of the existing aimed to redirect the lawbreaker to thesocial reintegration and preventing the use of drugs. To achieve this purpose it was adoptedthe qualitative research model, through bibliographical and documentary research, whichbargain greater credibility to this study. It can be seen through the current model adopted byjustice, which to target positive results in combating drug-related crime, it has to confrontprimarily the generator fact of the problem, that itself is the use of drugs.
