History and Judicialization of Brazilian Agrarian Question

Resumo: Seeking to be and instrument for clarification of historical facts determining thepublishing of a few laws related to Brazilian agrarian issue, this work, after brief historicalretrieve, focuses on the study of law 4.504/64 (Land Statute) and the complementary law76/93 (Expropriation with destiny to Agrarian Reform). Using bibliographic research, aswell as dialectics as an approach method, one sought to show thal such laws are the resultof social-political situations marked by intense popular mobilization along history. Thus,this work seeks to be, above all, an incentive to social movements that fight for LanReform and the operators of law who seek the construction of critical perspectives onlaw.

Utilizandoa pesquisa bibliográfica, bem como a dialética como método de abordagem, buscou-sedemonstrar que as leis objeto deste estudo são resultantes de conjunturas político-sociaisde intensas mobilizações populares ao longo da história.
