Resumo: Currently, management of hydrographic systems is an issue amply spread in Brazil and Portugal, once water is a consumer good essential to life and due to its uses it has presented conflicts in some regions of the country related to its inadequate use. Management systems which consider protectionto natural water sources must be structured as well as water quantitative and qualitative maintenance and rational and equally distributed use. Theaim of this article is to analyze the legal framework and institutional of water management along History in Brazil and Portugal, and the current plan forhydrographic basins. From the study of main instruments of regulation and management of hydric resources, it was possible to make a comparative approach and understand the models in effect in both countries.

From the study of main instruments of regulation and management of hydric resources, it was possible to make a comparative approach and understand the models in effect in both countries.Atualmente, o gerenciamento dos sistemas hidrográficos é uma temática largamente difundida no Brasil e em Portugal, pois a água é um bem essencial àvida e face aos seus usos vem apresentando conflitos em algumas regiões desses países em função do seu uso inadequado, devendo ser estruturado sistemas de gerenciamento que contemplem a proteção das fontes naturais, a conservação quantitativa e qualitativa da água, e o seu uso racional e justamente distribuído. Dessa forma, o objetivo desse artigo é analisar o arcabouço legal e institucional da gestão das águas ao longo da história no Brasil e em Portugal, como também o planejamento atual das bacias hidrográficas. A metodologia do estudo consistiu em levantamento bibliográfico e documental.
