Marrakech Treaty on accessibility to literary works to people with visual disabilities: the responsibility of the editorial market in effectiveness of personality rights

Resumo: The Treaty of Marrakech aims to enable blind people, people with visual impairments or other reading difficulties, access, in an alternative format, to the content of originally printed books, and was incorporated into Brazilian law with the force of a constitutional rule. Based on the text of the treaty and its internal implementation, the rights of people with visual impairments will be analyzed, as inherent and essential to their development. Using deductive reasoning, through bibliographic and documentary, descriptive and exploratory research, the article concludes that for the effectiveness of the guarantees provided for in the international document, the recognition of the constitutional status in the Brazilian legal system is not enough. It is necessary, on the one hand, political action in order to eliminate obstacles that are covered by economic interests, and, on the other hand, conscious action and imbued with social responsibility on the part of the publishing market.

A partir do texto do tratado e implementação no âmbito interno, analisar-se-á os direitos das pessoas com deficiência visual, como inerentes e essenciais ao seu desenvolvimento. Valendo-se do raciocínio dedutivo, por meio de pesquisa bibliográfica e documental, descritiva e exploratória, o artigo conclui que para a efetividade das garantias previstas no documento internacional, não basta o reconhecimento do status constitucional no ordenamento jurídico brasileiro.
