Resumo: From the centralization of sexual violence problem perpetrated against women in the context of affective/conjugal relations in the hegemonic and androcentric order of gender, the present article aims to demonstrate the way in which the Law founded and continues to base the sexist speech. In this sense, we seek to detect where such discursive formations emerge, in order to deconstruct them and make space for speeches and other practices. Therefore, queer theory and feminist decolonial perspectives will be used. The methodology used in this article was exploratory nature, with a qualitative approach, starting from a legislative and doctrinal analysis, as well as from the examination of judgments handed down at the Tribunal de Justiça do Mato Grosso do Sul (TJMS - Court of Justice) from 2016 to 2020, through bibliographic and documentary procedure.

Nesse sentido, busca-se detectar de onde tais formações discursivas emergem, a fim de desconstruí-las e dar espaço a falas e práticas outras. Para tanto, utilizar-se-á da teoria queer e das perspectivas feministas decoloniais.
