Resumo: The present paper seeks to analyze the issue of the prepayment of court costs for appeals in the Small Claims Court system, with an emphasis on the cost prepayment for the so-called unnamed appeal. The goal is to challenge the theoretical limits that gravitate around the theme, raising methodological and explanatory considerations, as well as presenting a bibliographical review, an examination of judicial precedents and statements by important civil procedure institutions. The methodological axis of the research is to seek compatibility of the theme with the principles and rules set out in the 2015 Code of Civil Procedure, considering the sources dialogue theory. In addition, some proposals are presented to improve the appeal system of the Small Claims Court, based on new ideas and from researching legislative bills, with an emphasis on the proposal for unification of procedural rules between the unnamed appeal and the civil appeal with respect to the prepayment of costs and proof thereof.

A meta é problematizar os limites teóricos que gravitam em torno do tema, a partir das ponderações metodológicas indutivas, hipotéticas e explicativas, bem como pela revisão bibliográfica, o exame dos precedentes jurisprudenciais e a leitura dos enunciados de instituições processuais civis de referência. O eixo metodológico da pesquisa é buscar a compatibilização do tema com os princípios e as regras previstas no Código de Processo Civil de 2015, à luz da Teoria do Diálogo de Fontes.
