THE REBALANCING BETWEEN THE RULE OF LAW, DEMOCRACY AND CAPITALISM.

Resumo: This paper analyzes the organization formed by the elements rule of law, democracy and capitalism. It goes through concepts brought from authors and it exemplifies different times that prevailed varied forms of balance between the elements, in order to illustrate how complex this relationship is. The analysis delves into events after the Second World War, combining matter of State law, democracy and capitalism, where the intervening State took prominently interventionist role at a time of increased economic growth. After the expansion of popular demands and economic crises, the state funding led to reforms that reduced rights.

Esse artigo busca analisar a organização formada pelos elementos Estado de Direito, democracia e capitalismo. A partir de conceitos trazidos de autores, são pontuados diferentes momentos onde prevaleceram variadas formas de equilíbrio entre os elementos, visando ilustrar como é complexa essa relação. A análise se aprofunda nos acontecimentos após a Segunda Guerra Mundial, conciliando matéria de Estado, Direito, democracia e capitalismo, onde o Estado interventor assumiu papel proeminentemente interventor, num momento de maior crescimento econômico.
