RESUMOOs séculos XX e XXI deixaram uma preciosa herança normativa no tocante aos direitos humanos. Invariavelmente, porém, apresentaram-se barreiras a sua vigência e aplicação por força de sistemas positivos nacionais. Cite-se o exemplo do princípio da universalidade dos direitos humanos, cujo escopo é velar pela proteção de tais direitos como um primeiro dever do Estado, visto que a vigência desta matéria está amplamente disseminada pelo mundo, seja em decorrência da promulgação de normativas ou por ação de organizações internacionais. Ademais, corrobora a importância do tema direitos humanos outro princípio que encontra respaldo em sistemas jurídicos atuais, qual seja, o princípio da fundamentalidade constitucional dos direitos humanos, o qual aduz que uma maior garantia e efetividade ao tema direitos humanos dar-se-á se seus dispositivos voltados a matéria forem elevados a categoria de cláusulas pétreas. Palavras-Chave: Direitos Humanos. Direito Constitucional.   ABSTRACT The XX and XXI centuries left a precious heritage of rules regarding human rights. Invariably, however, some barriers showed up to the effectiveness and application by positive national systems. To mention the example of the principle of universality of human rights, whose purpose is to ensure the protection of such rights as the first duty of the State, since the duration of this theme is widely disseminated around the world, whether as a result of the promulgation of regulations or due to the international organizations actions. Moreover, corroborates the importance of the human rights issue another principle that finds support in current legal systems, namely, the principle of constitutional fundamentality of human rights, which argues that greater effectiveness and guarantees to this topic will be their devices turned the matter are elevated to the category of Clausulas petreas. Key words: Human Rights.
