RESUMOO vertiginoso desenvolvimento tecnológico experimentado pela sociedade moderna traz implicações em todos os ramos do conhecimento, no que se inclui o direito e a economia. Especialmente no que diz respeito à utilização de novas tecnologias no livre mercado, parece cada vez mais evidente as vantagens que podem ser obtidas pelos players que detêm as melhores condições para apreender e aplicar o conhecimento tecnológico na produção. Desse modo, a partir do desafio proposto pela Constituição Federal de 1988 de se buscar o desenvolvimento econômico nacional de modo inclusivo e do recorte de análise desse mesmo desenvolvimento dentro de um segmento de mercado, o de bebidas frias, pretende-se enfrentar como o (in)acesso à tecnologia, pelas pequenas e médias empresas, pode acarretar na limitação da livre concorrência, norteando a pesquisa a partir da teoria institucional de Douglas North.Palavras-chave: Assimetria Tecnológica; Mercado de Bebidas Frias; Teoria Institucional.ABSTRACTThe vertiginous technologic development experimented by the modern society brings implications in all fields of knowledge, including law and economy. Specially with respect to the utilization of new technologies in the free market, it seems more and more evident the benefits that can be obtained by players that hold the best conditions to learn and apply the technologic knowledge in production. That way, from the challenge proposed by the Federal Constitution of 1988 of searching the national economic development in an inclusive wag and of the analysis of this same development inside a market segment, the one of cold beverages, it is intended to face as the access to technology by small and medium sized enterprises might have consequences in the limitation of free competition, from the institutional theory of Douglas North.Keywords: Technological Asymmetry; Free Market; Institutional Theory.
