ELDER AND LABOUR LAW: THE IMPACT OF SOCIAL AND LABOUR MEASURES AGAINST COVID-19 PANDEMIC

Resumo: Social restriction measures aiming to protect the community against possible mass virus contamination are necessary and even recommended by health authorities. However, they have negative effects, mainly impacting the elderly and workers. This work aims to reflect on the impacts that social measures have on elder and labour rights, seeking possible coping measures, in order to achieve a balance between the need of the right to security and the restriction of fundamental rights, mainly those of freedom. Based on bibliographic and documentary research, the information will be analyzed under a theoretical and doctrinal screen. Using a descriptive, qualitative and exploratory methodology, the systematization of considerations will be enriched and supported by a sociolegal foundation.

Sin embargo, tienen efectos negativos, que afectan principalmente a los ancianos y los trabajadores. Este trabajo tiene como objetivo reflexionar sobre los impactos que las medidas sociales y laborales tienen sobre los derechos de los trabajadores y las personas mayores, buscando posibles medidas de afrontamiento, a fin de lograr un equilibrio entre la necesidad del derecho a la seguridad y la restricción de los derechos fundamentales, especialmente los de libertad. Basado en la investigación bibliográfica y documental, la información será analizada bajo la pantalla teórico-doctrinal. Utilizando una metodología de naturaleza descriptiva, cualitativa y exploratoria, la sistematización de las ponderaciones será enriquecida y respaldada por la base legal-social.Medidas de restrição social com o objetivo de proteger a coletividade contra possível contaminação do vírus em massa são necessárias e até recomendadas pelas autoridades de saúde. No entanto provocam efeitos negativos impactando principalmente os idosos e os trabalhadores. Este trabalho tem por objetivo fazer uma reflexão sobre os impactos que medidas sociais e trabalhistas provocam nos direitos dos trabalhadores e dos idosos, buscando possíveis medidas de enfrentamento, de modo a obter o equilíbrio entre a necessidade do direito à segurança e a restrição dos direitos fundamentais, principalmente os de liberdade. Com base nas pesquisas bibliográfica e documental as informações serão analisadas sob o crivo teórico-doutrinário. Utilizando-se de metodologia de natureza descritiva, qualitativa e exploratória a sistematização das ponderações serão enriquecidas e sustentadas pelo fundamento jurídico-social.Centro Universitário Salesiano de São Paulo - U.E.
