Resumo: The pandemic caused by the new coronavirus marks the peculiarity of the year 2020 that Brazil is experiencing. One of the recommendations of the world health organization is social distance, which invariably impacts on labor relations in different sectors of the economy. In order to alleviate the damage caused, several labor laws are being enacted under the argument of preserving workers' jobs and income, such as, for example, flexibilization by individual agreements, which has been increasingly accepted. In this sense, the present work defends the use of the collective writ of mandamus, filed by unions, to safeguard rights and protect, above all, the work environment and the rights of workers' personality, in the case of abuses of this apparent flexibility, to the detriment of workers. workers. The research is theoretical and the method is inductive, starting from particular questions for conclusions on the issue.

Para paliar el daño causado, se están promulgando varias leyes laborales bajo el argumento de preservar el empleo y los ingresos de los trabajadores, como, por ejemplo, la flexibilización por convenios individuales, que cada vez tiene más aceptación. En este sentido, el presente trabajo defiende el uso del recurso colectivo de mandamus, interpuesto por los sindicatos, para salvaguardar derechos y proteger, sobre todo, el ambiente laboral y los derechos de la personalidad de los trabajadores, en el caso de abusos de esta aparente flexibilidad, en detrimento de los trabajadores. trabajadores. Uma das recomendações da organização mundial da saúde é o distanciamento social o que, invariavelmente, impacta nas relações trabalhistas de diversos setores da economia. Com o intuito de amenizar os danos causados, diversas legislações trabalhistas estão sendo editadas sob o argumento de preservar o emprego e a renda dos trabalhadores, como por exemplo, a flexibilização por acordos individuais, que vem sendo cada vez mais consentida. Nesse sentido o presente trabalho defende o uso do mandado de segurança coletivo, impetrado por sindicatos, para resguardar direitos e proteger, sobretudo, o meio ambiente do trabalho e os direitos da personalidade dos trabalhadores, no caso de abusos desta aparente flexibilização, em detrimento dos trabalhadores.
