Metaphors about maternity: a cognitive-discursive analysis in second degree decisions about parental removal actions

Resumo: | Law and the Judiciary are places of production of knowledge about motherhood. We do an analysis of the use of laws about the exercise of maternity in judicial processes, through the identification of metaphors about mothers in decisions of appeal in parental removal actions. Not only the seminal studies of Lakoff and Johnson (2002), but also the Metaphor-led Discourse Analysis Approach (Cameron, 1999; CAMERON et al., 2009; CAMERON, LARSEN-FREEMAN, 2007) were used to identify metaphors about motherhood, with the conception that the theory of legal argumentation should be constructed in interdisciplinary terms, with the help of studies on discourse developed by linguistics. Such approach aligns with the interdisciplinary perspective in the human and social sciences (PEDERSON, 2016). The identified metaphors indicated the use of common sense views on motherhood as the basis for the removal of maternal family power, contrary to the constitutional principles of equality and non-discrimination. |

Este artigo propõe-se a uma análise do uso feito, em processos judiciais, das leis sobre o exercício da maternidade, por meio da identificação das metáforas sobre as mães em decisões proferidas em graus de recurso em ações de destituição do poder familiar. Utilizou-se não só os estudos seminais de Lakoff e Johnson (2002), mas também a Abordagem da Análise do Discurso à Luz da Metáfora (Cameron, 1999; CAMERON et al., 2009; CAMERON, LARSEN-FREEMAN, 2007), para identificar as metáforas sobre a maternidade, com a concepção de que a teoria da argumentação jurídica deve ser construída interdisciplinarmente, com o auxílio dos estudos sobre o discurso desenvolvidos pela linguística. Tal abordagem alinha-se à perspectiva interdisciplinar nas ciências humanas e sociais (PEDERSON, 2016).
