Resumo: This article has the scope to analyze the constitutional principle of the freedom of education from the point of view of the Federal Constitution of 1988. First, an approach is made on the right to education, the cradle of the right to freedom of education, which aims to promote Citizenship, humanization, the appreciation of access to knowledge, access and permanence in school and quality education, with the purpose of training critical and conscious subjects capable of acting in society. Subsequently, it will investigate the right to freedom of teaching in its conceptual aspect, in addition to the justification for applying this right in teaching activity, joining it to the right to pluralism of ideas.

Primeramente se hace un abordaje sobre el derecho a la educación, cuna del derecho a la libertad de enseñanza, que tiene el objetivo de promover la ciudadanía, la humanización, la valorización del acceso al conocimiento, del acceso y de la permanencia en la escuela, así como de la enseñanza de cualidad, con la finalidad de formar sujetos críticos y conscientes, capaces de actuar en sociedad. Posteriormente investiga el derecho a l libertad de enseñanza en su aspecto conceptual, allá más de la justificativa para aplicación de este derecho en la actividad docente, uniéndolo al derecho al pluralismo de ideas. Este artigo tem o escopo de analisar o princípio constitucional da liberdade de ensino sob a óptica da Constituição Federal de 1988. Primeiramente, faz-se uma abordagem sobre o direito à educação, berço do direito à liberdade de ensino, o qual tem por objetivo promover a cidadania, a humanização, a valorização do acesso ao conhecimento, do acesso e da permanência na escola, bem como do ensino de qualidade, com a finalidade de formar sujeitos críticos e conscientes, capazes de agir em sociedade.
