From forgetfulness to the deindexation: the internacional development of the controversy about the right to be forgotten e and the limitation of brazilian jurisprudence

Resumo: | The present essay analyses the development of the right to be forgotten starting from paradigmatic judgments, foreigners and nationals in kind, especially, on the recognition of the called right to be deindexed. Adopting as our underlying theme the jurisprudence in what concerns Lebach´s case, which took place in Germany, as well as Mario Costeja González v. Google, which occued in Spain, we seek to analyse critically how has been developed the brazilian jurisprudence regarding the right to be forgotten, through the understanding that was established by the Brazilian Court in the matter of the Aída Curi´s case, along with it´s revisions and limitations. Concerning the method, this research is qualitative, comprehensive and critical-reflexive in nature, adopting academic sources such as jurisprudence, with emphasis for the Brazilian Suprme Court of Justice´s decisions related to the right to be forgotten. As theoretical framework, were adopted a serie of doctrinial reflexions, especially, the opinion of Jorge Manrique, Stefano Rodotà and Francisco Javier Leturia Infant. In conclusion, it is shown how the brazilian jurisprudence has not still absorbed completely the right to be forgotten. Despite the fact that the brazilian jurisprudence has already approved the tecnical strategy of the deindexation, has not still progressed in what concerns the material dimension, that is, on the clarification of the contents which can limit viewers. Overcoming this challenge may be the brazilian contribution to the international development regarding a new perspective to the controversy of the right to be forgotten. |

Com esse novo direito supera-se algumas das dificuldades práticas em impedir a veiculação midiática de conteúdo ofensivo na internet. Adotando como fio condutor os julgamentos dos casos Lebach, ocorrido na Alemanha, e Mario Costeja González v. Google, ocorrido na Espanha, busca-se analisar criticamente a formação do entendimento jurisprudencial brasileiro sobre o direito ao esquecimento, a partir do entendimento firmado no julgamento do caso Aída Curi pelo Superior Tribunal de Justiça, bem como de suas revisões e limitações. Metodologicamente, a pesquisa qualitativa, de viés compreensivo e crítico-reflexivo, vale-se de fontes doutrinárias, legislativas e jurisprudenciais, com destaque para as decisões do Superior Tribunal de Justiça envolvendo o direito ao esquecimento. Como referencial teórico, são adotadas as reflexões doutrinárias sobre o direito ao esquecimento, especialmente, nas formulações de Jorge Manrique, Stefano Rodotà e Francisco Javier Leturia Infante. Em conclusão, aponta-se como a jurisprudência brasileira ainda não assimilou plenamente o direito à desindexação. Apesar de já ter reconhecido a estratégia técnica da desindexação, ainda não avançou na sua dimensão material, no esclarecimento dos conteúdos que fazem jus à restrição dos buscadores.
