The “agency model” and the economic incentives for occupational accidents prevention

Resumo: Abstract: This article connects the “agency model” with the fundamental right to the prevention of occupational accidents, from the point of view of Law and Economics. Based on an approach to the necessary effectiveness of social rights related to the reduction of labour inherent risks, prevention is affirmed as a human and fundamental right, while it is shown that accidents still occur frequently in Brazil and all the world, what demonstrates a disrespectful reality to the precautionary principle. The study also deals with the social costs of occupational accidents and the current economic incentives to the prevention choice, facing microeconomic concepts and costs with prevention and repair notions, as well as benefits with the adoption of preventive measures. Finally, the agency problem is presented, showing the relation between the “agent” employer and the “agent” employee facing the society, while presents the contribution of this model to stimulate the choice for prevention, attributing the obligation of monitoring the employee to the employer, which is who can run it more efficiently.Keywords: Fundamental rights. Agency model.Resumo: Neste artigo faz-se uma conexão do “modelo de agência” com o direito fundamental à prevenção de acidentes de trabalho, sob a ótica da Análise Econômica do Direito. A partir de uma abordagem da necessária efetividade dos direitos sociais relacionados à redução dos riscos inerentes ao trabalho, afirma-se a prevenção como um direito humano e fundamental, ao mesmo tempo que se mostra que os acidentes ainda ocorrem com elevada frequência no Brasil e no mundo, o que evidencia uma realidade desrespeitosa ao princípio da precaução. No estudo trata-se, ainda, sobre os custos sociais decorrentes dos acidentes de trabalho e os incentivos econômicos atuais à escolha da prevenção, enfrentando conceitos da microeconomia e noções de custos com prevenção e reparação, além dos benefícios com a adoção de medidas preventivas. Finalmente, apresenta-se o problema da agência, que relaciona o papel do “agente” empregador e do “agente” empregado em face da sociedade e a contribuição desse modelo para estimular a escolha pela prevenção, atribuindo a obrigação do monitoramento do empregado ao empregador, que é quem pode executá-lo de maneira mais eficiente.Palavras-chave: Direitos fundamentais.
