Resumo: This course conclusion work aims to analyze the institute of adoption by same-sex couples under the Brazilian legal system, noting the importance of how this theme has been affecting the social fabric in relation to the composition of the family, which undergoes constant changes in the modern world, highlighting the relation of this transformation with principles protected by the Federal Constitution of 1988, also addressing the impact of the joint judgment of Direct Unconstitutionality Action (ADI) No. 4277 and Action for Non-Compliance of basic principles (ADPF) No. 132 on the possibility of bilateral adoption when performed by same-sex couples. The objective of this monograph is to analyze the possibility of joint homoparental adoption, observing how it is structured, also probing the guiding principles of the adoption institute and its application in these cases. In order to enable the progress of the research, jurisprudential, doctrinal and legal tools were used, following the deductive bibliographic method. The jurisprudential research on the websites of the Superior Court of Justice and the Federal Supreme Court, as well as in the jurisprudence of the Courts of São Paulo and Rio Grande do Sul, reveal the recognition of the homo-affective family, which has rights and duties inherent to the family power and the means to carry out the adoption prior to this recognition.

O objetivo da presente monografia é analisar a possibilidade da adoção homoparental conjunta, observando como se dá a sua estruturação, sondando também os princípios norteadores do instituto da adoção e sua aplicação nesses casos. No intuito de possibilitar o andamento da pesquisa, foram utilizadas ferramentas jurisprudenciais, doutrinárias e da legislação, seguindo o método bibliográfico dedutivo.
