Resumo: This study aimed to analyze the school history of teenagers who responded judicial process and have or haven't fulfilled social-educative measures in order to show the relationship between school failure or educational gap within the social and family context and also with the difficulties to return to school. The analysis sought to identify elements that contribute to understanding the educational process of young people who engage in illegal acts. Analysis of school reports, monitoring of the judiciary technical staff and monitoring of the staff of social-educative measures contained in lawsuits of teenager people from four different public schools in two municipalities of São Paulo state. This work is a qualitative research, which was based on document analysis (constant reports in court proceedings). The hypothesis was that most teenager people who were involved with illegal acts had school discrepancy (age/grade) and/or history of abandonment, which led to de reduction of the protective system that the school provides, that could be reported. The vast majority of the adolescent that committed infractions indicated some difficulties that marked the period that they spent by the school and also showed that some of the teens that committed infractions did not attend to school. It was also evident that decisions on implementation and monitoring of educational measures, or even protective measures are subsidized by social, psychological and educational studies, the effectiveness of the actions become more concrete, guarantying the rights foreseen in the Statute of Children and Adolescents

Na análise procuramos identificar elementos que contribuam para compreender o processo educativo de jovens que se envolvem com atos infracionais. Foram analisados os relatórios escolares e de acompanhamento da equipe técnica do poder judiciário e da equipe de acompanhamento da execução das medidas (relatórios psicossociais) constantes nos processos judiciais de jovens pertencentes a quatro escolas públicas de dois municípios do interior paulista, quando do ato infracional. Trata-se de pesquisa qualitativa, que se utilizou de análise documental (relatórios constantes nos processos judiciais). A hipótese era de que grande parte dos jovens que se envolveram com atos infracionais apresentavam defasagem escolar (idade/série) e/ou histórico de abandono, reduzindo o sistema protetivo que a escola possibilita, o que pôde ser constatado. A grande maioria dos jovens autores de atos infracionais indicaram alguma dificuldade que marcou o período em que passaram pela escola e evidenciou-se também que alguns dos adolescentes não frequentavam a escola quando do ato infracional. Evidenciou-se a ausência de informações relativas à situação familiar e contexto social dos adolescentes nos processos judiciais.
