Formas de vida da mulher brasileira no discurso jurídico

Resumo: Assuming that French semiotics allows the analyzis of several languages and textual genres, women's ways of life were sought to be verified in the legal discourse, in the main Brazilian laws related to women, from some articles belonging to the Civil Code of 1916 to the advent of the Law 11340, known as Maria da Penha Law, which was published on August 7th, 2006. For this reason, considerations about the relationship between semiotics and law were made, since legal texts were considered to belong to the legislative field, according to E. Landowski's studies on socio-semiotics. Also, it was considered that the advent of a law is an event that somehow, or at least in a collective and a potential way, breaks a routine, for all citizens usually must know and obey the current laws of their county. It is believed that it is possible to demonstrate semiotic practices and stereotypes manifested in each legal text with regard to women's ways of life. From this premise, two questions emerge: how does the legal discourse in the form of laws reflect these practices? Through what enunciation strategies does it occur? In order to answer these questions, the postulates of French semiotics, mainly those related to A. J. Greimas' studies, the foundations of legal semiotics and J. Fontanille's, C. Zilberberg's and E. Landowski's latest postulates about ways of life, were applied. Finally, the architecture of legal texts was sought to be revealed. These texts were considered an event that breaks a routine and proposes new semiotic practices, habits, language games, i.e. ways of life, which imply the denial or referendum of previous practices concerning women. In a broader sense, it is a study related to semiotics of cultures, according to greimasian conception

In a broader sense, it is a study related to semiotics of cultures, according to greimasian conceptionRésumé: En supposant que la sémiotique française permet d'analyser plusieurs langages et genres textuels, nous avons cherché à vérifier les formes de vie féminine dans le discours juridique, dans les principales lois brésiliennes relatives aux femmes, dès quelques articles du Code civil de 1916 jusqu'à l'avènement de la Loi nº 11340, publiée le 07 août 2006, aussi connue comme la Loi « Maria da Penha ». Pour cela, nous avons tissé des considérations concernant la relation entre la sémiotique et le Droit, puisque nous considérons le texte légal appartenant à celui-ci, dans le sillage d'Eric Landowski, dans ses études sur la sociosémiotique. Nous croyons qu'il est possible de mettre en évidence les pratiques sémiotiques et les stéréotypes manifestés dans chaque texte légal en ce qui concerne les modes de vie de la femme. En partant de cette prémisse, des questions se posent: comment le discours juridique, sous la forme de lois, reflète ces manifestations stéréotypées? Comment et avec quelles stratégies énonciatives il l'a fait? Afin de répondre à ces questions, nous avons récouru aux postulats de la sémiotique française, principalement aux études de A. J. Greimas, aux fondements de la sémiotique juridique et aux plus récents postulats de J. Fontanille, C. Zilberberg et E. Landowski, quant aux formes de vie. Enfin, nous avons cherché à révéler l'architecture du texte juridique-légal, considéré comme un événement qui rompt une routine et qui propose de nouvelles pratiques sémiotiques et nouvelles axiologies, bref des formes de vie, qui impliquent la négation ou le référendum de pratiques antérieures en ce qui concerne le sujet femme. Dans un sens plus large, il s'agit d'une étude liée à la sémiotique des cultures, selon la conception greimassiennePartindo do pressuposto de que a semiótica francesa permite analisar várias linguagens e gêneros textuais, buscamos verificar as formas de vida feminina no discurso jurídico, nas principais leis brasileiras, referentes à mulher, desde alguns artigos do Código Civil de 1916 até o advento da Lei nº 11340, publicada em 7 de agosto de 2006, conhecida como Lei Maria da Penha. Para isso, tecemos considerações quanto às relações entre semiótica e direito, uma vez que consideramos o texto legal pertencente a este, na esteira de Eric Landowski, em seus estudos relativos à sociossemiótica. Consideramos ainda o advento de uma lei como um acontecimento que rompe, de alguma maneira, ao menos coletiva e potencial, uma rotina, pois normalmente, todos os cidadãos devem conhecer e obedecer à legislação vigente no país. Acreditamos ser possível evidenciar as práticas semióticas e os estereótipos manifestados em cada texto legal no que diz respeito às formas de vida da mulher. Partindo dessa premissa, surgem questionamentos: como o discurso jurídico, na forma de leis, reflete essas manifestações estereotipadas? Como e com quais estratégias enunciativas o faz? Com objetivo de responder a essas indagações, recorremos aos postulados da semiótica francesa, principalmente aos estudos greimasianos, aos fundamentos da semiótica jurídica e aos mais recentes postulados de Jacques Fontanille e Claude Zilberberg, no tocante a formas de vida. Buscamos, enfim, revelar a arquitetura do texto jurídico-legal, tomado como acontecimento que rompe uma rotina e propõe novas práticas semióticas, usos, jogos de linguagem, enfim, formas de vida, que implicam a negação ou referendo de práticas anteriores, a respeito do sujeito mulher.
