Resumo: This paper aims of analyzing the concept of Transitional Justice from the Security Council and the Human Rights Council and how these models have been presented from the functional particularities of each body. The Special Rapporteurship of the Human Rights Council has the strong concern to accommodate the debate from the Human Rights as a primary reference, while the Security Council from the paradigm of international security and politics. This has a repercussion in the work of the United Nations demonstrating advances and cautions of the Organization in relation to the Transitional Justice actions of its Member States.

A Relatoria Especial do Conselho de Direitos Humanos tem a forte preocupação de acomodar o debate sobre Direitos Humanos como referência primordial, enquanto o Conselho de Segurança baseado no paradigma da segurança e política internacional.
