This paper presentes aims to approach health care in Brazil, from the hypothetical-deductive method, discussing at first about the public health like a fundamental right and the implementation of public policies. It focuses on the private assistance provided by the private initiative in a supplementary way to the State, under the terms of article 199 of the Federal Constitution, under the perspective of articles 6, "caput" and 196, of the Federal Constitution, considering that health is a social right and the absent of public system assistance, the private iniciative provide an economical activity limiting risks. So then a need for state intervention of economic domain by regulating the health insurance sector in setting norms and measures of action in the market by the National Agency of Supplementary Health, in order to guarantee the public interest. To verify the limits of private companies responsability unther the health judicialization it will analyze the judicial actions recommended to the private health care of contracted health services. Finally, it is concluded through interaction between private and public initiatives, considering, by one side, the supremacy´s protection of the public interest aimed at the realization of the fundamental right to health, and, the another side, the balance in the provision by Operators in order to preserve autonomy and negotiating freedom.
