Resumo: | The purpose of this work is to investigate a possible relationship between Marxism and human rights under current social conditions. The study begins examining the political role of natural law during the XVIII and XIX centuries, as well as its social and economic expression in concrete terms during that same period. The next step was to recover how the thoughts of Karl Marx and Friedrich Engels the founders of Marxism - evolved on law and on human rights. This endeavor demanded the study of the philosophical, historical, social, economic and political conceptions of these two authors as they constitute the theoretical foundations for an understanding of the Marxian-Engelsian approach to law and human rights. As a conclusion, it will be established that: a) on one hand, at juridical-philosophical level, there is an unsolvable contraction between Marxism and human rights; b) on the other hand, a considerable portion of the practical agenda of human rights (not the entire agenda) the resulting part of social conquests with a emancipatory bias is in harmony with the Marxist political platform of the period prior to the surpassing of social production based on capital; c) beyond capital, the contradiction between Marxism and human rights would find a solution at the moment there is no social and historical need for law (and, therefore, of human rights) which is the corresponding form to the capitalist mode of production. |

O trabalho começa por examinar a função política cumprida pela teoria do direito natural nos séculos XVIII e XIX, bem como o modo concreto pelo qual passou a ter existência social e econômica na época. Em seguida, intenta recuperar a evolução do pensamento de Karl Marx e de Friedrich Engels porque fundadores do marxismo no que concerne ao direito e aos direitos humanos. Essa empreitada demandará o resgate das concepções filosófica, histórica, social, econômica e política desses dois autores, porque constituem os fundamentos teóricos para a compreensão do enfoque marxiano-engelsiano sobre o direito e os direitos humanos.
