Resumo: The author relates the relationship that he sees between Bioethics and Legal Medicine. His comprehensive concept of Legal Medicine appoints it's necessity for the builting of Law; this concept amplifies the traditional idea that Legal Medicine is restricted to medical and biological knowledges regarding legal issues (definition of Flaminio Fávero), suggesting a new image of "sciences of life applicated to Law". Concearing Bioethics, the author focuses the attempt of this branch of Ethics to discuss a hierarchy os values referring human life and health. Concluding, the author demonstrates the convergence of Legal Medicine and Bioethics, both contributing to the implantation of a social and legal organization.

Parte de um conceito bastante abrangente desta última, apontando o imperativo de sua existência na estruturação do Direito, e considerando-a não apenas ciência médico-biológica (na acepção clássica de Flaminio Fávero), mas "ciência da vida aplicada ao Direito". Daí, passa a discorrer sobre o conceito atual da Bioética, indicando sua metodologia voltada para uma hierarquização dos valores envolvidos na vida e na saúde humana e propondo a autonomia do indivíduo na estruturação dessa hierarquia. O autor destaca ainda sua visão anti-positivista do saber médico, mostrando exemplos de profissionais que, à luz do mesmo saber, posicionaram-se opostamente em questões éticas e políticas. Concluindo, clarifica a confluência entre Medicina Legal e Bioética, ambas indispensáveis para o Direito, como, aliás, já era admitido pelos autores clássicos de Medicina Legal (embora sob outra forma), quando falavam de Medicina Legal e Deontologia Médica.Universidade de São Paulo.
