PASSIVOS CONTINGENTES NA BOLSA DE VALORES DE NOVA YORK: UMA ANÁLISE COMPARATIVA ENTRE AS EMPRESAS ESTRANGEIRAS

Resumo: | The study raised the contingent liabilities of 102 companies that publish their financial statements under IFRS on the NYSE. It was considered that the following factors could affect the financial significance of contingent liabilities: (i) sector of the company, (ii) the legal system of the country of the company and (iii) the social values of the country of the company, reflected by the theory of Gray (1988). Gray's theory (1988) could be confirmed in the isolated analysis of Latin developed countries (Brazil), Anglo (England) and colonial Asia (China). Contingent liabilities are also distributed differently between continents, whereas in Latin America the predominance is of tax contingent liabilities, civil litigation in Europe and Asia / Pacific financial guarantees. It was found that Brazilian companies tend to show more contingencies than the others and that the majority of its contingent liabilities (67%) are tax related. The environmental contingencies are more relevant in the oil and gas companies |

Considerou-se que os seguintes fatores poderiam afetar a significância financeira dos passivos contingentes: (i) setor da empresa, (ii) o sistema legal do país da empresa e (iii) os valores sociais do país da empresa, refletidos pela teoria de Gray (1988). A teoria de Gray (1988) pôde ser confirmada na análise isolada dos países latinos desenvolvidos (Brasil), anglo (Inglaterra) e Ásia colonial (China). Os passivos contingentes também se destacam com distribuições diferentes entre os continentes, onde na América Latina a predominância é dos tributários, na Europa os processos cíveis e na Ásia / Pacífico as garantias financeiras. Verificou-se que as empresas brasileiras tendem a evidenciar mais contingências que as demais e que a maioria das contingências lá evidenciadas (67%) são tributárias. As contingências ambientais são mais relevantes nas empresas do setor de petróleo e gás.Universidade de São Paulo.
