Direitos ecológicos intergeracionais: a atuação do ministério público para assegurar o direito ao futuro

Resumo: | Os direitos humanos evoluíram ao longo do último século, estando na terceira geração, que abrange o direito ao meio ambiente ecologicamente equilibrado. A preocupação com a proteção do meio ambiente teve início na década de 1960, ganhando proporção a partir da década seguinte, com a Conferência das Nações Unidas sobre o Meio Ambiente Humanos, de 1972. A partir daí seguiu-se um movimento internacional de constitucionalização da proteção ambiental, começando pela Europa, tendo chegado ao Brasil em 1988, quando houve a inauguração do direito ambiental brasileiro, tal como o conhecemos hoje. A Constituição Federal de 1988 determina que, além de garantir direitos ambientais para as futuras gerações, cabe ao Ministério Público a defesa dos direitos coletivos, de que faz parte o meio ambiente íntegro, avançando-se na ideia de um direito ecológico. Assim, esta tese tem como objetivo geral analisar o papel do Ministério Público na defesa dos direitos ambientais e na proteção das atuais e futuras gerações, descrevendo o marco conceitual, constitucional e jurisdicional brasileiro e internacional. Objetiva também: i) examinar o marco conceitual da preservação do meio ambiente a partir do olhar dos direitos humanos, descrevendo a evolução da sensibilidade ambiental e os princípios da preservação e da defesa ambiental, bem como detalhando os princípios ambientais intergeracionais; ii) demonstrar aspectos da visão intergeracional dos direitos e da justiça, descrevendo a determinação do princípio da responsabilidade segundo Hans Jonas e as manifestações normativas da área; iii) identificar a atuação normativa que cabe ao Ministério Público na tutela da integridade ambiental, como forma de garantir o direito ao futuro, a transição intergeracional e a manutenção da humanidade no Planeta. Quanto ao modo de abordagem, utiliza metodologia de pesquisa qualitativa e exploratória, com procedimentos técnicos bibliográficos e documentais. A investigação contempla reflexões sobre o fato de que as gerações atuais e as gerações futuras já possuem direitos, especialmente o de usufruírem e receberem, respectivamente, um meio ambiente que lhes proporcione condições vitais mínimas (ar, água e energia). Para isso, diante de tantos danos que o Planeta vem sofrendo, o equilíbrio ambiental e o uso sustentável dos recursos naturais devem ser tutelados pelo Ministério Público, tanto judicial como extrajudicialmente, pois é de sua atribuição defender os direitos difusos e, com isso, garantir a transição intergeracional, inclusive dos seres não- humanos. Para tanto, é relevante discutir o papel do Ministério Público na proteção dos direitos das futuras gerações ao meio ambiente ecologicamente equilibrado e se estes direitos abrangem também outros seres vivos não-humanos, tendo como base a ética da responsabilidade e os princípios que norteiam a construção dessa relação entre presente e futuro. Conclui que o avanço proposto por esta tese está exatamente na compreensão de que cabe ao Ministério Público a tutela dos direitos ambientais das futuras gerações, humanas ou não-humanas, com fundamento na ética da responsabilidade de Hans Jonas, ampliando-se sobremaneira a interpretação dos limites das atribuições ministeriais. |

The concern with the protection of the environment began in the 1960s, gaining proportions from the following decade, with the United Nations Conference on the Human Environment, in 1972. From then on, an international movement of constitutionalization of the environmental protection, starting in Europe, having arrived in Brazil in 1988, when there was the inauguration of Brazilian environmental law, as we know it today. The Federal Constitution of 1988 determines that, besides guaranteeing environmental rights for future generations, it is up to the Public Ministry to defend collective rights, which include an intact environment, advancing the idea of an ecological right. Thus, this thesis has the general objective of analyzing the role of the Public Ministry in the defense of environmental rights and in the protection of current and future generations, describing the Brazilian and international conceptual, constitutional and jurisdictional framework. It also aims to: i) examine the conceptual framework of environmental preservation from the point of view of human rights, describing the evolution of environmental sensitivity and the principles of environmental preservation and defense, as well as detailing the intergenerational environmental principles; ii) demonstrate aspects of the intergenerational vision of rights and justice, describing the determination of the principle of responsibility according to Hans Jonas and the normative manifestations of the area; iii) to identify the normative action that is the responsibility of the Public Ministry in the protection of environmental integrity, as a way of guaranteeing the right to the future, the intergenerational transition and the maintenance of humanity on the Planet. As for the approach, it uses qualitative and exploratory research methodology, with bibliographic and documentary technical procedures. The investigation contemplates reflections on the fact that current and future generations already have rights, especially to enjoy and receive, respectively, an environment that provides them with minimum living conditions (air, water and energy). For this, in the face of so much damage that the Planet has been suffering, the environmental balance and the sustainable use of natural resources must be protected by the Public Ministry, both judicially and extrajudicially, since it is their responsibility to defend collective rights and, with that, guarantee the intergenerational transition, including that of non-human beings. Therefore, it is relevant to discuss the role of the Public Ministry in protecting the rights of future generations to an ecologically balanced environment and whether these rights also cover other non-human living beings, based on the ethics of responsibility and the principles that guide the construction this relationship between present and future. It concludes that the advance proposed by this thesis is precisely in the understanding that it is up to the Public Ministry to protect the environmental rights of future generations, human or non-human, based on Hans Jonas' ethics of responsibility, greatly expanding the interpretation of limits of ministerial powers.Los derechos humanos han evolucionado a lo largo del último siglo, encontrándose en la tercera generación, que engloba el derecho a un medio ambiente ecológicamente equilibrado. La preocupación por la protección del medio ambiente se inició en la década de 1960, cobrando proporciones a partir de la década siguiente, con la Conferencia de las Naciones Unidas sobre el Medio Humano, en 1972. A partir de entonces, un movimiento internacional de constitucionalización de la protección ambiental, partiendo de Europa, ha llegado a Brasil en 1988, con la inauguración del derecho ambiental brasileño, tal como lo conocemos hoy. La Constitución Federal de 1988 determina que, además de garantizar los derechos ambientales para las generaciones futuras, corresponde al Ministerio Público defender los derechos colectivos, que incluyen el medio ambiente intacto, avanzando en la idea de un derecho ecológico. Así, esta tesis tiene como objetivo general analizar el papel del Ministerio Público en la defensa de los derechos ambientales y en la protección de las generaciones presentes y futuras, describiendo el marco conceptual, constitucional y jurisdiccional brasileño e internacional. También tiene como objetivo: i) examinar el marco conceptual de la preservación ambiental desde el punto de vista de los derechos humanos, describiendo la evolución de la sensibilidad ambiental y los principios de preservación y defensa ambiental, así como detallar los principios ambientales intergeneracionales; ii) evidenciar aspectos de la visión intergeneracional del derecho y la justicia, describiendo la determinación del principio de responsabilidad según Hans Jonas y las manifestaciones normativas del área; iii) identificar la acción normativa que le corresponde al Ministerio Público en la protección de la integridad ambiental, como forma de garantizar el derecho al futuro, la transición intergeneracional y el mantenimiento de la humanidad en el Planeta. En cuanto al abordaje, utiliza metodología de investigación cualitativa y exploratoria, con procedimientos técnicos bibliográficos y documentales. La investigación contempla reflexiones sobre el hecho de que las generaciones actuales y futuras ya tienen derechos, especialmente para disfrutar y recibir, respectivamente, un medio ambiente que les proporcione las condiciones mínimas de vida (aire, agua y energía). Por ello, ante tanto daño que viene sufriendo el Planeta, el equilibrio ambiental y el aprovechamiento sustentable de los recursos naturales deben ser tutelados por el Ministerio Público, tanto judicial como extrajudicialmente, ya que es su responsabilidad defender los derechos colectivos y, con ello, garantizar la transición intergeneracional, incluida la de los seres no humanos. Por lo tanto, es relevante discutir el papel del Ministerio Público en la protección de los derechos de las generaciones futuras a un medio ambiente ecológicamente equilibrado y si estos derechos abarcan también a otros seres vivos no humanos, con base en la ética de la responsabilidad y los principios que orientan la construcción de esta relación entre presente y futuro. Se concluye que el avance que propone esta tesis está precisamente en el entendimiento de que corresponde al Ministerio Público proteger los derechos ambientales de las generaciones futuras, humanas o no humanas, a partir de la ética de la responsabilidad de Hans Jonas, ampliando mucho la interpretación de los límites de los poderes Os direitos humanos evoluíram ao longo do último século, estando na terceira geração, que abrange o direito ao meio ambiente ecologicamente equilibrado. A preocupação com a proteção do meio ambiente teve início na década de 1960, ganhando proporção a partir da década seguinte, com a Conferência das Nações Unidas sobre o Meio Ambiente Humanos, de 1972. A partir daí seguiu-se um movimento internacional de constitucionalização da proteção ambiental, começando pela Europa, tendo chegado ao Brasil em 1988, quando houve a inauguração do direito ambiental brasileiro, tal como o conhecemos hoje. A Constituição Federal de 1988 determina que, além de garantir direitos ambientais para as futuras gerações, cabe ao Ministério Público a defesa dos direitos coletivos, de que faz parte o meio ambiente íntegro, avançando-se na ideia de um direito ecológico. Assim, esta tese tem como objetivo geral analisar o papel do Ministério Público na defesa dos direitos ambientais e na proteção das atuais e futuras gerações, descrevendo o marco conceitual, constitucional e jurisdicional brasileiro e internacional. Objetiva também: i) examinar o marco conceitual da preservação do meio ambiente a partir do olhar dos direitos humanos, descrevendo a evolução da sensibilidade ambiental e os princípios da preservação e da defesa ambiental, bem como detalhando os princípios ambientais intergeracionais; ii) demonstrar aspectos da visão intergeracional dos direitos e da justiça, descrevendo a determinação do princípio da responsabilidade segundo Hans Jonas e as manifestações normativas da área; iii) identificar a atuação normativa que cabe ao Ministério Público na tutela da integridade ambiental, como forma de garantir o direito ao futuro, a transição intergeracional e a manutenção da humanidade no Planeta. Quanto ao modo de abordagem, utiliza metodologia de pesquisa qualitativa e exploratória, com procedimentos técnicos bibliográficos e documentais. A investigação contempla reflexões sobre o fato de que as gerações atuais e as gerações futuras já possuem direitos, especialmente o de usufruírem e receberem, respectivamente, um meio ambiente que lhes proporcione condições vitais mínimas (ar, água e energia). Para isso, diante de tantos danos que o Planeta vem sofrendo, o equilíbrio ambiental e o uso sustentável dos recursos naturais devem ser tutelados pelo Ministério Público, tanto judicial como extrajudicialmente, pois é de sua atribuição defender os direitos difusos e, com isso, garantir a transição intergeracional, inclusive dos seres não- humanos. Para tanto, é relevante discutir o papel do Ministério Público na proteção dos direitos das futuras gerações ao meio ambiente ecologicamente equilibrado e se estes direitos abrangem também outros seres vivos não-humanos, tendo como base a ética da responsabilidade e os princípios que norteiam a construção dessa relação entre presente e futuro. Conclui que o avanço proposto por esta tese está exatamente na compreensão de que cabe ao Ministério Público a tutela dos direitos ambientais das futuras gerações, humanas ou não-humanas, com fundamento na ética da responsabilidade de Hans Jonas, ampliando-se sobremaneira a interpretação dos limites das atribuições ministeriais. |
