Resumo: The present study aims to analyze the viability of the living will in the Brazilian legal system and and to provide support for its legality, as well as explain what this institute is and what it serves. In the development of the study, the method of qualitative approach was used, as it was based on general premises to reach particularities about the subject. As for the level, the study fits into the exploratory field, due to the deep verification about the problem, in order to allow for precise considerations about the living will. In addition, the research procedure used was the bibliographical one, with the research in doctrines, articles and jurisprudence. Throughout the study, it was obtained as a result, that the living will is viable in the Brazilian legal system, and can be used by every fully capable person. In this way, it is concluded that the living will is based on the constitutional principles, the jurisprudence of the TJRS and the resolutions of the Federal Council of Medicine, being totally legal.

No desenvolvimento do estudo, foi utilizado o método de abordagem qualitativo, pois partiu-se de premissas gerais para chegar às particularidades sobre o assunto. Já quanto ao nível, o estudo se encaixa no campo exploratório, em decorrência da verificação profunda acerca do problema, a fim de possibilitar considerações precisas sobre o testamento vital. Além disso, o procedimento de pesquisa utilizado foi o bibliográfico, com a pesquisa em doutrinas, artigos e jurisprudência. Através de todo o estudo, obteve-se como resultado que o testamento vital é viável no ordenamento jurídico brasileiro e pode ser utilizado por toda pessoa plenamente capaz.
