Uma dessas inovações é o sistema de videoconferência. Ele tem sido aplicado, no processo penal, como um instrumento para se alcançar maior celeridade no curso do processo e para redução de gastos. A utilização desse sistema no processo penal tem encontrado resistência, pois se entende que há uma violação aos direitos fundamentais dos indivíduos, sobretudo, o valor supremo da dignidade da pessoa humana. Existem tratados, convenções e a Constituição Federal que resguardam esses direitos, primando pelos valores dos seres humanos e pela garantia de um processo penal justo. O Estado Democrático de Direito deve assegurar esses direitos e garantias aos indivíduos processados criminalmente. A jurisprudência das Cortes Superiores e parte da doutrina entendem que o interrogatório por videoconferência não deve ser aplicado. Esse procedimento leva a uma violação aos princípios constitucionais do processo penal, o que ocasiona a inconstitucionalidade de sua aplicação.The world evolves and consequently new technologies appear. One of these innovations is the videoconferencing system. It has been applied in criminal proceedings, as a tool to achieve more rapid progress in the process and to reduce expenses. Using this system the prosecution has found resistance, because it believes that there is an infringement on the fundamental rights of individuals, especially the supreme value of human dignity. There are treaties, conventions and the Federal Constitution that protect those rights, press the values of human beings and the guarantee of a fair criminal proceeding. The democratic rule of law must ensure these rights and guarantees to individuals criminally prosecuted. The jurisprudence of the Supreme Courts and the doctrine believe that the interrogation by video should not be applied.
