Right to genetic intimacy: a contribution to personality rights

Resumo: Genetic information is part of the general medical databank, comprehending genetic and proteomic data, as well as being present in biological samples. The great amount of data in it leads to the idea of a transparent man. Genetic information is unique, structural, predictive, probabilistic and generative. Genetic data identify and characterize the individual by the adoption of a its own genetic endowment, and different from other beings, a reflex of its individuality and its personal character. The right to genetic intimacy is defined as the right to determine the conditions of access to genetic information. The objective element of genetic intimacy right refers to the human genome and, in the last instance and by derivation, to any tissue or part of the human body where genetic information is found. The subjective aspect to the genetic intimacy rights refers to the right “not to know” the results of genetic proofs carried out on the person or on a relative. In addition to that, the axiological dimension of the genetic intimacy right finds in the human person dignity its objective fundament, in face of the fact that the genome is what differentiates all human beings among themselves, and also it is what differentiates the human specie from all others. Taking this line of reasoning, the theory of general personality rights consubstantiate in a true general clause of the juridical system, having the unitary set as object, the person’s dynamic and evolving assets and essential valuables, as basic support, the fundamental principle expressed in article 1o, III, of the Federal Constitution, in other words, human being dignity. As a result, as the genetic intimacy rights is not provided in any normative, the axiological dimension based on the human person dignity constitutes the greater point of connection and fundament to bring it up to the level of a personality rights of the human being.

La gran cantidad de datos en ella comprendidos lleva a la idea del hombre transparente. La información genética es única, estructural, preditiva, probalística y generacional. Los datos genéticos identifican y caracterizan el individuo a través de una dotación genética propia y distinta de los demás seres, por ser reflejo de su individualidad y de su carácter personal. El derecho a la intimidad genética se difine como el de determinar las condiciones de acceso a la información genética. El elemento objetivo del derecho a la intimidad se refiere al genoma humano y, en última instancia y, por derivación, a cualquier tejido o parte del cuerpo humano en que se encuentre la información genética. El aspecto subjetivo del derecho a la intimidad genética se refiere al derecho a "no saber" los resultados de análisis genéticas practicadas en si mismo o en otro familiar. Además, la dimensión axiológica del derecho a la intimidad genética encuentra en la dignidad de la persona humana fundamento objetivo, ante el hecho de que el genoma es lo que distingue todos los seres humanos entre si, y también es lo que distingue la espécie humana de todas las demás. En ese eje de raciocínio, la teoría del derecho general de la personalidad se consubstancía en una verdadera cláusula general del sistema jurídico, y posee como objeto el conjunto unitario, dinámico y evolutivo de los bienes y valores esenciales de la persona, como soporte básico, el principio fundamental expreso en el art. 1º, III, de la CF, o sea, el de la dignidad de la persona humana. De eso resulta que, como derecho a la intimidad genética no se prevé en ninguna normativa, a su dimensión axiológica basada objetivamente en la dignidad de la persona humana, constituye el punto de conexión y fundamento mayor para erigirlo al alcance de uno de los derechos de la personalidad del ser humano.A informação genética é parte do acervo geral dos dados médicos, compreendidos os dados genéticos e proteômicos, bem como se encontra presente nas mostras biológicas. A grande quantidade de dados nela compreendidos leva à idéia de homem transparente. A informação genética é única, estrutural, preditiva, probalística e geracional. Os dados genéticos identificam e caracterizam o indivíduo através de uma dotação genética própria e distinta dos demais seres, sendo reflexo de sua individualidade e de seu caráter personalíssimo. O direito à intimidade genética se define como o direito a determinar as condições de acesso à informação genética. O elemento objetivo do direito à intimidade genética se refere ao genoma humano e, em última instância e,por derivação, a qualquer tecido ou parte do corpo humano em que se encontre a informação genética. O aspecto subjetivo do direito à intimidade genética se refere ao direito a “não saber” os resultados de provas genéticas praticadas em si ou em um familiar. Ademais, a dimensão axiológica do direito à intimidade genética encontra na dignidade da pessoa humana seu fundamento objetivo, ante o fato de que o genoma é o que diferencia todos os seres humanos entre si, e também é o que diferencia a espécie humana de todas as outras. Nessa linha de raciocínio, a teoria do direito geral da personalidade se consubstancia em uma verdadeira cláusula geral do sistema jurídico, tendo como objeto o conjunto unitário, dinâmico e evolutivo dos bens e valores essenciais da pessoa, como suporte básico, o princípio fundamental expresso no artigo 1º, III, da CF, ou seja, o da dignidade da pessoa humana.
